Should residential sewers block the property?

The treatment methods of residential sewer blockage should be as follows:

1. Property management companies are obliged to maintain and repair public facilities and equipment in residential areas;

2. The blockage of sewer pipe caused losses. First of all, we must find out what is the cause of sewer blockage. If it is because the sewer pipe is in disrepair for a long time, and the property management company fails to find the maintenance in time, which leads to the overflow of the owner in the normal use process, then the property management company fails to fulfill the maintenance obligation agreed in the contract and shall bear the liability for breach of contract;

3. If it is caused by improper use of the upstairs owner, such as throwing some garbage into the sewer pipe, which affects the normal drainage of the sewer pipe, then the upstairs owner should compensate. In this case, if the property company has fulfilled its reasonable duty of care and failed to fulfill its obligation to find faults and maintain them in time, then the property company will not bear the responsibility;

4. If the sewer pipe in the community is blocked, then the property should be managed. According to the relevant provisions of the property contract, the property has the responsibility to repair and maintain the public facilities and equipment in the community. The public sewer pipe belongs to the community public facilities, and there is a blockage problem. The property has the responsibility to dredge the sewer. If the sewer pipe in the owner's house is blocked, the owner is responsible for dredging it himself, and the property has no obligation to help the owner maintain it.

Legal basis: Article 17 of the Regulations of People's Republic of China (PRC) Municipality on Property Management.

The management agreement shall stipulate the use, maintenance and management of the property, the interests of the owners, the obligations that the owners should perform and the responsibilities that they should bear if they violate the management agreement. Management regulations shall respect social morality and shall not violate laws and regulations or harm public interests.
