Legal basi for not agreeing to install elevator on that first floor

1. It is not allowed to install elevators on the first floor, and it is not allowed to forcibly install elevators. All owners must agree to install elevators in the old building. If one of them does not agree, it cannot be installed. To build a building in a planned urban area, legal land use rights must be obtained before applying for planning permission.

2. Legal basis: Article 274 of the Civil Code of People's Republic of China (PRC).

Roads within the building division belong to the owner, except those belonging to urban roads. The green space within the building division belongs to the owner, except for urban public green space or express personal green space. Other public places, public facilities and property services within the building division are owned by the owner.

Article 275

In the building division, the ownership of planned parking spaces and garages shall be agreed by the parties through sale, gift or lease.

Parking spaces that occupy roads or other venues owned by the owner for parking cars shall be owned by the owner.

Article 49 of the Regulations on Property Management

Public buildings and facilities planned and constructed within the property management area shall not be changed. If the owners need to change the use of public buildings and facilities according to law, they shall inform the property service enterprises after handling the relevant formalities according to law; If the realty service enterprise really needs to change the use of public buildings and facilities, it shall be submitted to the owners' meeting for discussion and approval, and the owners shall go through the relevant formalities according to law.
