Regulations of Sichuan Province on the Administration of Agricultural Machinery

Chapter I General Provisions Article 1 In order to strengthen the management of agricultural machinery, establish and improve the service system of agricultural mechanization, protect the legitimate rights and interests of producers, operators and users of agricultural machinery, promote agricultural mechanization and promote rural economic development, these Regulations are formulated in accordance with the provisions of the Agricultural Law of People's Republic of China (PRC) and the Law of the People's Republic of China on Agricultural Technology Promotion, and in light of the actual situation in Sichuan. Article 2 All units and individuals engaged in scientific research, education, popularization, production, sale, use, maintenance and management of agricultural machinery within the administrative area of Sichuan Province must abide by these regulations. Article 3 Agricultural machinery as mentioned in these Regulations refers to power machinery, working machinery and equipment used in agricultural production, rural agricultural and sideline products processing, rural transportation and agricultural engineering. Article 4 Local people's governments at all levels shall strengthen their leadership over agricultural mechanization, incorporate it into the rural economic development plan and organize its implementation, and actively support the construction of socialized service system for agricultural machinery. The fifth provincial people's government department in charge of agricultural machinery is responsible for the management of agricultural mechanization in the province.

City, state, county (city, district) people's government and the competent department of agricultural machinery of the regional administrative office shall be responsible for the management of agricultural mechanization within their respective administrative areas. Sixth local people's governments at or above the county level shall be responsible for the competent department of agricultural machinery:

(a) to implement the laws, regulations, rules and policies related to agricultural mechanization, and to supervise and manage the state-owned assets occupied and used by subordinate enterprises and institutions;

(two) to formulate and organize the implementation of agricultural mechanization development planning, raise funds for agricultural mechanization development, manage the special funds for agricultural mechanization invested by the state and various agricultural mechanization service facilities, and be responsible for the collection and release of agricultural mechanization information;

(3) Establish and improve the service system of agricultural machinery, organize socialized service of agricultural machinery, be responsible for the coordination, supply and reserve of agricultural machinery oil, and organize agricultural machinery to fight disasters and provide relief;

(four) to organize and guide the development of agricultural mechanization projects and the research, popularization, education and training of new technologies of agricultural machinery, implement industry management of the production, sales and maintenance of agricultural machinery, and implement the safety supervision and management of agricultural machinery according to law. Seventh units and individuals that have made remarkable achievements in the management of agricultural machinery shall be commended and rewarded by the local people's government. Chapter II Scientific Research, Popularization, Education and Training of Agricultural Machinery Article 8 Institutions engaged in scientific research, popularization, education and training of agricultural machinery shall, according to the needs of agricultural and rural economic development, carry out research and development, demonstration, popularization and technical training of new technologies and tools of agricultural machinery. Ninth agricultural mechanization technical school is responsible for training agricultural machinery driving, operation, maintenance and management personnel, and carry out various technical training around social needs. Without the approval of the competent department of agricultural machinery of the people's government at a higher level, the nature and property rights of the school shall not be changed. Article 10 Agricultural machinery technology popularization institutions at all levels shall participate in the formulation of agricultural machinery popularization plans and organize their implementation, provide agricultural machinery technology and information services, and guide lower agricultural machinery technology popularization institutions, mass science and technology organizations and agricultural machinery technology popularization personnel to carry out agricultural machinery technology popularization activities. Eleventh to encourage agricultural machinery technology promotion institutions at all levels to promote agricultural workers in the region has been proved to be advanced and applicable agricultural machinery new technology, new equipment.

Popularizing new technologies and new machines of agricultural machinery that have not been proved advanced and applicable by local experiments to agricultural labourers, and causing losses to agricultural labourers, shall bear civil liability for compensation. Chapter III Socialized Service Article 12 The township (town) agricultural machinery management service station is a rural grass-roots state institution, which is specifically responsible for the management of agricultural mechanization in the township (town). Township (town) agricultural machinery management service station by the competent department of agricultural machinery of the people's government at the county level and the township (town) people's government in accordance with their respective responsibilities, the implementation of dual leadership. Thirteenth township (town) agricultural machinery management service station is mainly responsible for, must be presided over by the competent department of agricultural machinery of the local people's government at or above the county level, according to the provisions of the state for professional assessment. Fourteenth township (town) agricultural machinery management service station and the assets of its enterprises, except the assets purchased by the state, belong to the township (town) agricultural machinery management service station, and no organ or unit may occupy or allocate them free of charge. Article 15 the township (town) agricultural machinery management service station shall timely do a good job in the technical condition inspection and maintenance of all kinds of agricultural machinery, reserve oil for agricultural machinery operation according to regulations, do a good job in the supply service of local agricultural machinery oil, and be responsible for the statistical work of agricultural mechanization in the township (town). Article 16 The township (town) agricultural machinery management service station shall gradually improve the socialized service system of rural agricultural machinery, and organize village agricultural machinery technology extension organizations and owners of agricultural machinery to carry out agricultural machinery services with mechanized tillage, machine seeding, irrigation and drainage, plant protection, harvesting, transportation, processing and storage as the main contents. Seventeenth serious natural disasters, the local people's governments at or above the county level or township (town) people's government can mobilize agricultural machinery into emergency rescue and disaster relief activities. After the rescue and disaster relief, the people's government shall give appropriate compensation according to the losses of the owners of agricultural machinery. Eighteenth to encourage and support the township (town) agricultural machinery management service station to set up all kinds of enterprises or other economic organizations that serve agriculture, purchase advanced and applicable agricultural machinery, and enhance the function of serving agriculture and rural economy.
