Regulations of Zhangjiakou Municipality on Property Management
The term "property management" as mentioned in these Regulations refers to the activities of the owners to maintain, conserve and manage the buildings, structures and their supporting facilities, equipment and related sites within the property management area through self-management or entrusting property service providers to make joint decisions, and to maintain environmental sanitation and related order. Property service providers include property service enterprises, professional units and other property managers. Article 3 Property management adheres to the principles of party building leading, government leading, owner autonomy, multi-party participation and consensus through consultation. Article 4 The people's governments at the city and county levels shall incorporate property management into the development planning of modern service industry, community construction planning and social governance system, and establish a comprehensive coordination mechanism for property management such as a joint meeting system for property management.
Encourage the adoption of new technologies and methods, promote the deep integration of the Internet and property management, and promote the standardized and healthy development of the property service industry in this Municipality. Fifth city and county housing and urban and rural construction departments in accordance with the principle of territorial management, responsible for property supervision and management within their respective jurisdictions, perform the following duties:
(a) to study and formulate policies related to property management and property service industry norms;
(two) to supervise and manage the daily work of property service enterprises and employees;
(three) to accept the property service contract for the record and the property undertaking inspection for the record;
(four) supervision and management of the extraction and use of maintenance funds and other related matters;
(five) to coordinate the handling of contradictions and disputes in property management;
(six) other duties as prescribed by laws and regulations. Article 6 Relevant municipal and county-level competent departments shall, in accordance with the division of responsibilities, do a good job in property supervision and management:
(a) the civil affairs department is responsible for guiding the residential areas that have not implemented property management to rely on the neighborhood (village) committees to implement autonomous management;
(II) The comprehensive administrative law enforcement department of urban management is responsible for investigating and dealing with illegal behaviors such as raising livestock and poultry in violation of regulations, occupying and destroying green space, cutting down trees without authorization, and posting advertisements on street buildings without authorization; To change the use, form, color or materials of buildings, structures and other facilities without authorization, to change the facade of houses without authorization, to build illegally and other illegal acts, and to impose administrative penalties according to law;
(three) the market supervision and management department is responsible for investigating the unlicensed operation in the property management area; Responsible for the safety supervision of elevators, boilers and other special equipment in the property management area, and investigate and deal with illegal acts in the installation, renovation, maintenance and use of special equipment; Responsible for the supervision and inspection of property service charges within the property management area, and investigate and deal with all kinds of price violations according to law;
(four) the public security organs are responsible for carrying out community policing, strengthening public security prevention in property management areas, promoting the construction of smart and safe communities, and investigating and dealing with illegal acts that affect public security and public order in residential areas;
(five) the competent department of ecological environment is responsible for the supervision and management of environmental protection within the property management area;
(six) the price department in conjunction with the relevant departments is responsible for the formulation and adjustment of government-guided property service charges;
(seven) the health department is responsible for the prevention and control of infectious diseases and the supervision of drinking water hygiene in the property management area;
(eight) planning, finance, administrative examination and approval, emergency, civil air defense, justice and other relevant departments in accordance with their respective responsibilities to do a good job in property supervision and management. Seventh street offices (Township People's Government) shall perform the following duties of property supervision and management:
(a) to organize and guide the establishment of the owners' congress, elect the owners' committee, set up the property management committee, organize and guide the general election of the owners' committee, and be responsible for the record of the owners' committee;
(two) to guide and supervise the owners' congress and the owners' committee to perform their duties according to law;
(three) to guide and supervise the property service providers to perform their obligations according to law, and to supervise and inspect the implementation of property services;
(four) the establishment of property management contradictions complaint mediation mechanism, coordinate the handling of property management disputes;
(five) responsible for the management of property files, assist in collecting and verifying the credit information of property service providers within their respective jurisdictions;
(six) other duties as prescribed by laws and regulations.
Neighborhood (village) committees assist and cooperate with neighborhood offices (township people's governments) to carry out property supervision and management, and guide and supervise the daily work of owners' congress, owners' committee and property service providers. Article 8 Establish a cooperative operation mechanism of neighborhood (village) committees, owners' committees and property service providers under the guidance of Party building, fully mobilize residents' participation enthusiasm, and form a joint force of community governance.
Party member, members of the owners' committee and property service personnel will be promoted as part-time members of community party organizations, and eligible members of the community "two committees" will also serve as members of the owners' committee through legal procedures. Article 9 Property services shall abide by the market rules of property services, which are consistent in power and responsibility, consistent in quality and price, honest and trustworthy, and fair and open competition, and maintain the market order of enjoying services and paying fees according to regulations. Encourage property service providers to optimize combination, collectivization and standardized operation, deepen scientific and technological support and optimize the market environment.
Give play to the role of government functions and support social capital to participate in property management in old residential areas.
