Chapter I General Provisions Article 1 In order to standardize property management activities, safeguard the legitimate rights and interests of property owners and property management enterprises, and improve the living and working environment of the people, these Regulations are formulated in accordance with the Regulations on Property Management of the State Council and the actual situation of the autonomous region. Article 2 These Regulations shall apply to property management and related activities within the administrative area of the autonomous region. The construction administrative department of the people's government of the third autonomous region shall be responsible for the supervision and management of the property management activities in the whole region.

The real estate administrative departments of the people's governments at or above the county level shall be responsible for the supervision and management of property management activities within their respective administrative areas. Other relevant administrative departments shall, in accordance with their respective duties, do a good job in property management according to law. Fourth people's governments at all levels should strengthen the management of the property management industry, guide the establishment of a professional, socialized and market-oriented property management mechanism, and promote the healthy development of the property management industry. Chapter II Owners and Owners' Congress Article 5 The owner of a house is the owner.

The owners' rights and obligations in property management activities shall be implemented in accordance with the relevant provisions of the Regulations of the State Council Municipality on Property Management. Article 6 The rights and obligations of property users in property management activities shall be agreed by the owners and users, but they shall not violate the relevant provisions of laws, regulations and the owners' convention.

Property users who violate these regulations and the provisions of the owners' convention shall be jointly and severally liable. Seventh a property management area to set up an owners' meeting.

The owners' meeting is composed of all owners in the property management area.

The owners' congress represents and safeguards the legitimate rights and interests of all owners in the property management activities within the property management area, and performs its duties in accordance with laws, regulations and the rules of procedure of the owners' congress. Eighth real estate administrative departments of the people's governments at or above the county level shall delimit the property management area according to the facilities and equipment, building scale, community construction and other factors. The specific measures shall be formulated by the administrative department of construction of the people's Government of the autonomous region.

The local people's government should organize and manage the property areas with imperfect supporting facilities and no property management conditions, create conditions and gradually implement property management. Owners' representatives in the preparatory group are recommended by all owners in the property management area within the specified time.

After the list of members of the preparatory group is confirmed, it will be published in writing in the property management area. Article 11 The preparatory group shall, within 30 days from its establishment, organize the owners to hold the first owners' meeting under the guidance of the real estate administrative department of the people's government at or above the county level where the property is located, and elect the owners' committee through the owners' convention and the rules of procedure of the owners' meeting.

If there is only one owner, or the number of owners is small, and all the owners agree to decide not to set up the owners' meeting, the owners shall jointly perform the duties of the owners' meeting and the owners' committee. Twelfth owners' voting rights at the first owners' meeting shall be determined according to the following criteria:

(a) residential property, according to the architectural design of each set of one vote.

(2) Non-residential property shall be calculated cumulatively by sections according to the construction area: if it is less than 100 square meter, one ticket shall be given for each certificate according to the house ownership certificate; From 10 1 m2 to 1000 m2, one ticket per1000 m2; 100 1 m2 to 2,000 m2, with one vote for every 200 m2; 200 1 m2 to 5000 m2, with one vote for every 300 m2; More than 5000 square meters, every 500 square meters for one vote.

After the first meeting of the owners' congress, the voting rights of the owners at the meeting of the owners' congress shall be determined by the rules of procedure of the owners' congress. Thirteenth owners' meeting can take the form of collective discussion, but also can take the form of written comments; However, there should be owners who hold more than half of the voting rights in the property management area.

The owners shall attend the owners' meeting. If he is unable to attend for some reason, he may entrust an agent to attend in writing. Article 14 A decision made by the owners' meeting must be approved by more than half of the voting rights held by the owners present at the meeting. The decision of the owners' congress to formulate and amend the owners' convention and the rules of procedure of the owners' congress, to hire and dismiss property management enterprises, to use special maintenance funds and to continue to raise funds must be approved by more than two-thirds of the voting rights held by all owners in the property management area.

The decision of the owners' meeting is binding on all owners in the property management area. Fifteenth owners of the property management area, according to the building, unit, floor and other units, elected a representative of the owners to participate in the owners' meeting.

If the owners' representatives are elected to attend the meeting of the owners' congress, the owners' representatives shall solicit the opinions of the owners they represent in writing on the matters to be discussed at the meeting of the owners' congress three days before attending the meeting. Need to vote, the owner's representative signed at the owners' meeting when voting truthfully reflect the specific votes of the owners for, against and abstained.

If the owner's representative is unable to attend the meeting of the owners' congress for some reason, the owner he represents may elect another owner's representative to attend.
