What is the procedure for dissolving the property contract?

When the owners terminate the realty service contract, they must convene the owners' congress or the owners' congress, and make a decision to terminate the realty service contract and dismiss the realty management enterprise.
The owner decides to terminate the property service contract in accordance with the following procedures:

The decision of the owners' congress to terminate the property service contract and dismiss the property management enterprise must be approved by more than two-thirds of the voting rights of all owners.
In the property management activities, in any of the following circumstances, the property management enterprise may make a decision to terminate the property service contract and stop the property management service activities:
(1) Property service contract expires;
(2) The realty service contract cannot be performed normally due to force majeure;
(3) The owner violates the property service contract and seriously interferes with the property management service activities, resulting in the property management enterprise being unable to perform the property service contract normally.
If one party makes a decision to terminate the realty service contract, it shall deliver it to the terminated party in written form, and inform the real estate management department of the county (autonomous county, city) where the property is located by letter.
The decision to terminate the realty service contract shall take effect when it is delivered to the terminated party. If the dismissed party has any objection, it can be settled through consultation, or it can apply for arbitration or bring a lawsuit to a people's court with jurisdiction according to law.
The property management enterprise shall, within 20 days from the effective date of the decision to terminate the property service contract, complete the handover to the owners' committee and leave. If the handover is not completed as scheduled, with the consent of the owners' committee, you can leave first; Those who leave without the consent of the owners' committee and cause economic losses shall be compensated according to law.
Property management enterprises that are re-employed by the owners' committee according to law may enter the site 2 1 day from the effective date of the dissolution decision.
When the two parties handle the handover, the property management enterprise shall make a list, settle the accounts, and refund more and make up less in accordance with the contract; Property management companies escrow property maintenance funds, should be a separate account and paid in full.
Property management companies must hand over property management houses to the owners' committee in accordance with relevant regulations.
Property management companies must hand over the following information to the owners' committee.
1, planning drawing, completion general plan, single building, structure, equipment completion drawing, ancillary facilities, underground pipe network project completion drawing and other completion acceptance data;
2, facilities, equipment installation, use and maintenance of technical information;
3, property quality assurance documents and property use documents;
4. Other information required for property services.
If the property service contract is terminated due to the fault of the property management enterprise, which causes losses to the owner, it shall be compensated according to law; If the property service contract is terminated due to the fault of the owner, causing losses to the property management enterprise, the property management enterprise may demand compensation for the losses and compensate its non-transferable upfront investment according to law.
