Provisions on fire safety management of large commercial complexes

Legal analysis: In order to standardize and strengthen the fire safety work of commercial complexes, implement standardized management of fire safety, implement the main responsibility of units and improve the management level of fire safety, these detailed rules are formulated according to the Fire Protection Law of People's Republic of China (PRC), the Implementation Measures of Fire Safety Responsibility System and the Provisions on Fire Safety Management of Organs, Organizations, Enterprises and Institutions.

The term "commercial complex" as mentioned in these Rules refers to a single building with two or more functions such as shopping, accommodation, catering, entertainment, exhibition and transportation hub, as well as a combination of multiple commercial buildings connected by underground contiguous garages, underground contiguous commercial spaces, sunken squares and corridors.

These Rules are applicable to commercial complexes that have been completed and put into use with a construction area of not less than 50,000 square meters (hereinafter referred to as "large commercial complexes"), and other commercial complexes may refer to the implementation.

Legal basis: Regulations on Fire Safety Management of Large Commercial Complex

Article 7 The property right units and users of large-scale commercial complexes are the main bodies responsible for fire safety of large-scale commercial complexes, and are responsible for fire safety work of large-scale commercial complexes.

Property units and users of large commercial complexes may entrust property service enterprises and other units (hereinafter referred to as "entrusted management units") to provide fire safety management services, and the specific service contents shall be agreed in the entrustment contract.

Article 8 Where a large-scale commercial complex is handed over to a contractor, lessee or manager by way of contracting, leasing or entrusted operation, the parties concerned shall specify the fire safety responsibilities of all parties when concluding the contract of contracting, leasing or entrusted operation.

When contracting, leasing or entrusting management, property units shall provide buildings that meet the requirements of fire safety, and urge users to strengthen fire safety management. The contractor, lessee or entrusted manager shall perform fire safety duties within the scope of their use, operation and management.
