According to "Several Opinions on Further Improving the Installation of Elevators in Existing Multi-storey Residential Buildings in this Municipality", the installation of elevators in existing multi-storey residential buildings (hereinafter referred to as "elevator installation") is the result of consensus reached by relevant owners, and the capital contribution is the same. The owner who has installed the elevator can ensure the safe and smooth operation of the installed elevator in accordance with the principle of "* * * building, * * * governance and * * * enjoyment". The specific opinions are as follows:

I. Implementing management responsibilities

Elevator installation management includes elevator use management and new building envelope and ancillary facilities and equipment (hereinafter referred to as "new facilities and equipment") management. The owner of the installed elevator can implement the elevator use management unit and the new facilities and equipment management unit to perform management responsibilities on its behalf. Innovate the management mode of "insurance service" to improve the insurance coverage of elevator use management.

(A) elevator use management

1. Determination of elevator use management unit. According to the relevant provisions of Shanghai Elevator Safety Management Measures, if the owner who has installed the elevator entrusts a residential property service enterprise or other elevator safety management unit to manage the elevator, the trustee is the elevator use management unit; If the elevator owner installs and purchases elevator use management insurance, he shall entrust the insured insurance company as the elevator use management unit in accordance with the contract; If the elevator owner manages the elevator by himself, the elevator owner is the elevator use management unit. If more than one elevator owner installs and manages the elevator by himself, it shall be agreed in writing that the actual person in charge of elevator management shall undertake the specific management work.

2. The responsibilities of the elevator management unit. Elevator use management units shall, in accordance with the laws, regulations and safety technical specifications of the state and this Municipality on elevator use management, actively perform their duties and do a good job in cleaning the elevator car and maintaining the lighting, fans and other equipment in the elevator car.

(2) Management of new facilities and equipment

1. Determination of new facilities and equipment management unit. If the elevator installation owner purchases elevator use management insurance, the insurance scope includes the management of new facilities and equipment, and the insured insurance company is the new facilities and equipment management unit; If the owner who has installed the elevator has not purchased the elevator use management insurance, or the insurance coverage does not include the management of new facilities and equipment, it shall entrust the property service enterprise in this community to manage the new facilities and equipment.

2 new facilities and equipment management unit responsibilities. The new facilities and equipment management unit shall, in accordance with the relevant agreements, do a good job in the daily cleaning, maintenance and regular inspection of the windows, lighting, floor tiles and the connecting structure with the house itself. If the management unit of new facilities and equipment finds that there are potential safety hazards in new facilities and equipment, it shall take emergency measures in time and inform the owners and owners' committees who have installed elevators. If the situation is serious, it shall also report to the local township. After receiving the notice or report, the owners, the owners' committee and the local towns and villages who have installed the elevators shall dispose of them in accordance with the Measures of Shanghai Municipality on the Administration of Housing Use Safety and other relevant regulations.

Second, fund raising and use

According to Shanghai Elevator Safety Management Measures and other relevant regulations, the expenses of daily management, energy consumption, maintenance, renovation, maintenance, inspection, safety assessment, entrusting others to manage services or purchasing related insurance (hereinafter referred to as "elevator installation management fee") shall be borne by the owner who installed the elevator.

(1) Opening an account for elevator installation management funds. Owners who have installed elevators can entrust the realty service enterprise in this community to open an account for the management of installed elevators, and set up an account according to the door number to implement daily management. Where a realty service enterprise accepts the entrustment to open and manage the management fund account for elevator installation, it shall reach a written agreement with the owner of elevator installation on account management fees and other related matters. Owners who have installed elevators can also open management fund accounts of installed elevators for daily management. If the owner of the installed elevator opens and manages the management fund account of the installed elevator by himself, it shall be agreed in writing that the account manager shall undertake the specific management work. Banks in Shanghai should further standardize and optimize their service processes and actively support the installation of elevators.

(two) to raise funds for the management of elevator installation. Owners who have installed elevators raise management funds for installing elevators by themselves. The funds for elevator installation management shall be collected by the representative elected by the owner of the elevator installation according to the house number (hereinafter referred to as "the representative of the owner of the elevator installation") and uniformly deposited into the elevator installation management account. When the account balance is insufficient, the representative of the owner who has installed the elevator shall promptly organize the owner who has installed the elevator to continue to raise funds according to the agreed proportion. Streets and towns can assist owners who organize the installation of elevators to raise funds for implementation.

(three) the use of elevator management funds. The management funds for installing elevators shall be used in accordance with the entrustment management agreement or the decision of the owner of installing elevators. Need to use the elevator installation management funds, by the representative of the owner of the elevator installation according to the elevator installation management agreement or the owner of the elevator installation decision, extracted from the elevator installation management fund account and paid to the relevant units. Relevant banks in Shanghai should earnestly fulfill the responsibility of entrusted management of funds.

Third, define rights and obligations.

After the concrete plan for installing the elevator is passed, the investors who install the elevator can sign an elevator installation agreement on the basis of consensus, clearly stipulating the ownership, use rules, management responsibilities and cost sharing of the elevator installation. The owner of the installation elevator agreed in the Agreement on Installation of Elevator shall enjoy relevant rights and obligations and perform relevant obligations according to law.

(a) when the ownership of the elevator owner's house changes, the rights and obligations related to the installation of the elevator shall be inherited by the changed owner of the house. Among them, if the owner who has installed the elevator transfers the ownership of the house by buying, selling or giving. He shall inform other owners who have installed the elevator in writing, and clearly inform the transferee of the rights and obligations of installing the elevator in the house sales contract and gift contract.

(2) If the owner of the elevator is a public housing tenant, after the change of the public housing tenant, the relevant rights and obligations of installing the elevator shall be inherited by the changed public housing tenant. Among them, if the lessee of public housing is changed by means of price difference, house exchange, etc., the owner of the elevator device shall inform other owners of the elevator device in writing, and clearly inform the rights and obligations of the transferee of the elevator device in the transfer contract of the lease right of public housing.

(3) When the owner of the elevator rents, lends or transfers the right to use the house by other means, he shall inform the transferee in writing of the rights and obligations of installing the elevator.

Fourth, the whole process of property service enterprises' participation

Property service enterprises should actively play their professional advantages and do the following work:

(1) Actively cooperate with the publicity of policies and regulations related to elevator installation in existing multi-storey houses, and assist in data collection, scheme formulation and consultation. , and according to the actual situation of the terrain, roads, greening, parking space configuration, pipeline location, etc., provide professional suggestions on the brand, model and architectural design scheme of elevator installation. , thus prompting the owner to reach a * * understanding of the installation of the elevator.

(two) actively cooperate with the original completion drawings and building materials, construction waste stacking. Relevant sites need to occupy residential roads or motor vehicle parking spaces, and should do a good job in road traffic and motor vehicle parking guidance. At the same time, cooperate with the construction unit to manage the site and maintain the order of the construction site.

(3) Take the initiative to undertake the entrustment of the owner of the installed elevator, provide management services for the use of the installed elevator, sign a written entrustment management agreement with the owner of the installed elevator on the basis of fairness, reasonableness and consensus, and clearly stipulate the specific contents such as service items, service contents, service standards, charging items and charging standards.

(4) If the owner of the installed elevator is the elevator use management unit, the realty service enterprise shall arrange a special person to be responsible for the supporting work of receiving the alarm at the monitoring room end of the elevator emergency alarm device, and cooperate with the owner of the installed elevator to do the relevant troubleshooting and maintenance work. If the insurance company is the elevator use management unit and it is indeed difficult, the property service enterprise may accept the entrustment of the insurance company to be responsible for the alarm work at the monitoring room end of the elevator emergency alarm device and collect relevant fees.
