Regulations of Tianjin Municipality on Property Management (revised in 2008)

Chapter I General Provisions Article 1 In order to standardize property management activities and safeguard the legitimate rights and interests of owners and property service enterprises, these Regulations are formulated in accordance with the Property Law of People's Republic of China (PRC), the Regulations on Property Management of the State Council and other relevant laws and regulations, combined with the actual situation of this Municipality. Article 2 These Regulations shall apply to property management activities within the administrative area of this Municipality. Article 3 The owner refers to the owner of the property. The term "property" as mentioned in these Regulations refers to houses and their supporting facilities, equipment and venues. The term "property management" as mentioned in these Regulations refers to the activities of the owners to maintain, conserve and manage the houses and their supporting facilities, equipment and related sites by hiring property service enterprises, and to maintain the environmental sanitation and related order in the property management area. Article 4 Property management shall follow the principles of openness, fairness, honesty and credit, market competition and standardized service. Fifth new residential property has more than two owners, should be subject to property management; Commercial, office, hospitals, schools, factories, warehouses and other non-residential properties, the implementation of property management. Article 6 The Municipal Bureau of Land Resources and Housing Management is the administrative department in charge of property management in this Municipality, and is responsible for the supervision and management of property management activities in this Municipality. The district and county real estate management bureaus are the administrative departments in charge of property management within their respective jurisdictions, and are responsible for the supervision and management of property management activities within their respective jurisdictions.

Planning, construction, city appearance, comprehensive law enforcement of urban management, public security, civil affairs, municipal administration, gardens, prices and other relevant departments shall be responsible for the relevant administrative management and services within the property management area according to their respective responsibilities. Article 7 Sub-district offices and Township People's governments shall define departments and personnel, be responsible for organizing and guiding the establishment of the owners' congress and the change of the owners' committee within their respective jurisdictions, supervise the owners' congress and the owners' committee to perform their duties according to law, mediate property management disputes among owners, owners' committees and property service enterprises, and coordinate the relationship between property management and community management and community service. Chapter II Owners, Owners' Congress and Owners' Committee Article 8 Owners shall enjoy the following rights:

(a) to participate in the owners' meeting, express their opinions and exercise their voting rights;

(two) the election of owners' representatives and members of the owners' committee, and enjoy the right to be elected;

(three) to supervise the work of the owners' committee;

(four) proposed to convene a meeting of the owners' congress, and put forward suggestions on matters related to property management;

(five) to formulate or modify the management statute and the rules of procedure of the owners' congress;

(six) in accordance with the provisions of the realty service contract, accept the services provided by the realty service enterprise;

(seven) to supervise the realty service enterprise to perform the realty service contract;

(eight) to supervise the management and use of special maintenance funds;

(nine) the right to know and supervise the use of * * * parts, * * facilities and equipment and related places;

(ten) other rights stipulated by laws and regulations. Article 9 The owner shall perform the following obligations:

(a) abide by the rules of procedure and management regulations of the owners' congress;

(two) to implement the decisions adopted by the owners' congress and the decisions made by the owners' committee authorized by the owners' congress;

(three) to cooperate with the property management activities carried out by the property service enterprises in accordance with the property service contract and management agreement;

(four) in accordance with the provisions of the property service contract, pay the property management service fee on time;

(five) to maintain public order and environmental sanitation in the property management area;

(six) in accordance with the provisions of the deposit or renewal of special maintenance funds;

(seven) other obligations stipulated by laws and regulations. Tenth a property management area to set up a general meeting of owners, should be implemented by a property service enterprise property management services.

New property projects, including construction by stages or by more than two development and construction units, whose supporting facilities and equipment are used by * * * *, shall be included in a property management area.

The above-ground and underground buildings, facilities and related sites in the same property management area shall not be divided for property management.

The division of property management areas should consider factors such as property facilities and equipment, building scale and community construction, and follow the principle of relative concentration and easy management. The specific measures for the regional division of property management shall be formulated by the Municipal People's Government. Eleventh new property has been delivered for use, in any of the following circumstances, the owners' meeting shall be established:

(1) The occupancy rate of the owners exceeds 50%;

(two) the first owner has actually lived for more than two years. Twelfth owners' congress is composed of all owners in the same property management area. Owners' Congress is an organization in which owners collectively exercise their rights in property management activities and safeguard the legitimate rights and interests of all owners.

The following matters shall be decided by the owners' meeting:

(a) to formulate and amend the rules of procedure and management regulations of the owners' congress;

(two) to elect and replace the members of the owners' committee and supervise the work of the owners' committee;

(three) to review the contents of the realty service contract and select the realty service enterprise;

(four) to formulate, revise and review the rules and regulations put forward by the realty service enterprise on the use of * * parts and * * facilities and equipment, and the maintenance of public order and environmental sanitation or other management matters in the realty management area;

(five) to formulate the plan for raising and using special maintenance funds, and supervise the implementation;

(six) the renovation of buildings and their ancillary facilities;

(seven) other major matters involving the management rights of the owners.
