Chapter I General Provisions Article 1 In order to strengthen the property management of urban residential quarters, ensure the normal use of houses and public supporting facilities, and create a civilized, safe, clean, convenient and beautiful living environment, these measures are formulated in accordance with relevant laws and regulations and combined with the actual situation of this Municipality. Article 2 These Measures shall apply to the property management of residential quarters with supporting living facilities in Fuzhou urban area.

The term "property management" as mentioned in these Measures refers to the maintenance, repair and renovation of housing construction and its equipment, municipal public facilities, greening, health, transportation, public security and environmental appearance management projects in residential areas. Article 6 A property management company shall operate according to law, and its business autonomy, income right, authorization and entrusted management right shall be protected by law. Chapter II Property Management Organization Article 7 When the occupancy rate of newly-built residential quarters exceeds 50%, the local subdistrict office shall, jointly with the district real estate management department and the development and construction unit, timely organize the first owners' meeting and elect the owners' committee. The owners' committee is responsible for the owners' meeting and reports its work.

The owners' meeting is composed of the owners of residential quarters and convened by the owners' committee at least once a year.

The owners' congress shall exercise the following functions and powers;

The documents produced by the owners' meeting shall be reported to the district real estate management department for the record and shall be binding on every household. Article 8 The owners' committee is a mass organization that represents and safeguards the legitimate rights and interests of the owners (tenants) of residential quarters, is responsible for the independent management of the property, and accepts the guidance and supervision of sub-district offices.

The owners' committee may invite residents' committees and other relevant units to participate in property management.

Responsibilities of the owners' committee:

(a) to formulate the articles of association of the owners' committee, the property management system and the household convention;

(two) put forward the expenditure plan of the basic property management fund and other property management funds;

(three) to determine the content of property management services, sign and terminate the property management contract;

(four) to supervise the property management work and service charges of the property management company;

(five) to listen to and reflect the opinions and suggestions of residents and accept the supervision of residents;

(six) to coordinate and solve disputes between residents and property management companies;

(seven) other duties entrusted by the articles of association of the owners' committee, the property management system and the household convention. Article 9 A property management company must meet the prescribed qualifications and hold a property management qualification certificate and business license before engaging in property management business. Tenth property management companies to undertake residential property management affairs, should sign a written contract with the owners' committee.

A property management contract shall specify the items, contents, expenses, contract term, rights and obligations of both parties and liabilities for breach of contract. Eleventh property management companies in residential areas, can implement the following property management:

(a) Repair and maintenance of the house and its ancillary facilities;

(two) environmental sanitation and cleaning, management and protection of flowers, trees and green spaces, and noise management;

(five) public security and public life order management;
