Jinan Property Management Regulations "Full Text" (3)

The full text of the Regulations of Jinan Municipality on Property Management

Forty-fourth property management area, owners and property users shall not engage in gambling, superstitious activities and other acts that endanger society; Do not raise animals in violation of regulations to interfere with the normal life of others; Do not store inflammable, explosive, toxic, radioactive and other dangerous goods; Do not occupy or block fire exits, or misappropriate or damage fire control facilities.

Forty-fifth owners and property users should sign a decoration service agreement with the property service enterprise before the start of residential decoration.

Owners, property users did not sign a decoration service agreement, the property service enterprise can restrict construction personnel from entering the property management area.

When the realty service enterprise inspects the residential decoration activities, the owner and the property user shall cooperate.

Forty-sixth after the expiration of the property warranty period, the owners shall be responsible for the maintenance and renewal of all their houses, parking spaces and other exclusive parts, and the expenses required shall be borne by the owners.

Forty-seventh after the expiration of the warranty period of the property, the owner shall undertake the maintenance and renewal of the parts and facilities used in the property management area.

If the property parts and facilities are damaged due to man-made reasons, the responsible person shall repair them in time and take responsibility for the losses caused.

Forty-eighth property service enterprises should improve the management and maintenance system of the parts and facilities of the property, strengthen the daily inspection and maintenance of the parts and facilities in accordance with the contract, and make records.

Elevator, boiler and other special equipment and automatic fire-fighting facilities shall be maintained by the owner or property service enterprise according to the property service contract, and the safety management responsibilities of all parties shall be clarified.

Forty-ninth water supply, power supply, gas supply, heating and other professional business units, should be responsible for the maintenance and renewal of professional business facilities and related pipelines within the property management area.

Fiftieth there are more than two owners in the property management area, and a special maintenance fund system shall be established.

Property special maintenance funds are earmarked for the maintenance, renewal and transformation of * * * old parts and * * * old facilities and equipment after the expiration of the warranty period.

Article 51 The owners of residential and non-residential properties in residential areas shall deposit the first phase of special maintenance funds into the special account for commercial residential maintenance funds before handling the house occupancy procedures. For houses that have not been deposited, real estate development enterprises shall deposit special maintenance funds.

Public housing units selling houses shall, in accordance with the relevant provisions, extract special maintenance funds from the sales funds and deposit them in the special account for after-sales public housing maintenance funds.

Fifty-second * * with parts, * * with the maintenance and renovation of facilities and equipment, and the use of special maintenance funds for property, shall be voted by the relevant owners.

In any of the following circumstances, which may endanger the safety of the owner's life and property, the maintenance fund can be extracted and used in accordance with the emergency maintenance procedures:

(a) roof leakage, external wall seepage, sewer pipe rupture, external wall falling off, road collapse and other verified by the owners' committee or community residents' committee;

(two) there are security risks in the operation of the elevator;

(three) the fire control facilities are out of order, and the fire control institution of the public security organ issues a fire control supervision and inspection record or issues a notice ordering rectification within a time limit.

In accordance with the emergency maintenance procedures to extract maintenance funds, it should be properly disposed of in the security risks, in the property management area to the owners of the use of maintenance funds.

Article 53 If the book balance of the special property maintenance fund is lower than 30% of the first deposit amount, or if the commercial house has been sold but the special property maintenance fund has not been established, the owners' committee shall organize the relevant owners to renew or supplement it. After meeting the needs of the owners, real estate development enterprises can rent the garage, but the lease period shall not exceed six months.

Fifty-fifth due to the lack of garage planning and construction, the owners' meeting may decide to occupy * * * roads or other venues in the property management area to set up parking spaces, but it shall not occupy fire exits or hinder road traffic.

If you use parking spaces, you should pay the parking space usage fee, which belongs to all owners.

Fifty-sixth owners are not allowed to occupy roads, green spaces or other * * * parking spaces within the property management area without authorization.

Fifty-seventh vehicles with undetermined parking spaces may be restricted from entering the property management area by the property service enterprise, except for public security, fire fighting, emergency rescue, ambulance and other special vehicles performing official duties and temporary parking.

Fifty-eighth property management area owners use the parts and facilities of all the owners, the use, distribution and management of the owners' meeting.

Chapter VI Supervision and Administration

Fifty-ninth housing security management, urban management and law enforcement, public security, quality supervision, municipal utilities, prices, urban and rural construction and other departments. A complaint and report acceptance system shall be established, complaint telephone numbers shall be published within the property management area, and illegal acts within the property management area shall be investigated and dealt with in a timely manner.

Sixtieth property service enterprises have one of the following acts, complain to the housing security management department:

(a) failing to provide services in accordance with the property service contract;

(two) engaged in property management without obtaining the qualification certificate;

(3) Entrusting all property management within the property management area to other units or individuals for management;

(four) to change the use of property services without authorization;

(five) leaving the property management area and stopping the property service without authorization;

(six) taking or misappropriating special maintenance funds for property.

Sixty-first in the property service management area, under any of the following circumstances, you can complain in the following ways:

(a) in violation of the provisions of article forty-third (a) to (seven), complain to the urban management law enforcement department;

(two) in the property warranty period due to engineering quality defects not timely maintenance, complaints to the urban and rural construction department;

(3) Occupying blocked fire exits, misappropriating damaged fire control facilities, affecting fire control safety, and complaining to the fire control institutions of public security organs;

(four) gambling, using superstitious activities to endanger society, illegally raising animals to interfere with the normal life of others, storing flammable, explosive, toxic and radioactive dangerous goods, and complaining to the public security organs;

(five) the elevator, boiler and other special equipment accidents, complaints to the quality supervision department;

(six) the property service enterprises charge fees in violation of regulations, and complain to the price department;

(seven) water supply, heating, gas supply professional business units did not bear the responsibility of professional management facilities and equipment and related pipeline maintenance, and complained to the municipal public sector;

(eight) the electric power professional business unit fails to undertake the maintenance responsibility of power lines, facilities and related equipment according to law, and complains to the competent department of economy and information technology.

Sixty-second county (city) and District People's governments shall establish a joint meeting system for property management, study, deploy and promote property management, and solve major contradictions and disputes in property management within their respective jurisdictions.

Article 63 Sub-district offices and township (town) people's governments are responsible for convening joint meetings of property management projects attended by housing security management and urban management law enforcement departments, public security police stations, community neighborhood committees, owners' committees or owners' representatives, and property service enterprises.

The joint meeting of property management projects shall coordinate the following matters:

(a) the owners' committee and relevant departments do not perform their duties according to law;

(two) the problems existing in the performance of the withdrawal procedures and handover of the property service enterprises;

(three) emergencies in the property management area;

(4) Problems in the connection and cooperation between property management and community management;

(five) other property management matters that need to be coordinated.

Involving the coordination of water supply, power supply, gas supply, heating, sanitation and other matters within the property management area, it shall notify the relevant professional business units to participate.

The convening unit of the joint meeting of property management projects shall sort out and keep the minutes of the joint meeting of property management projects.

Article 64 If the decisions made by the owners' congress or owners' committee violate laws and regulations, the neighborhood offices and township (town) people's governments where the property is located shall order them to correct or cancel their decisions within a time limit and notify all owners.

Sixty-fifth city housing security management department shall establish a credit information management system for property service enterprises, and strengthen the supervision and management of property service enterprises. The credit information of a realty service enterprise shall be publicized to the public and used as the basis for enterprise performance evaluation. The specific measures shall be formulated by the municipal housing security management department.

Sixty-sixth city property service industry associations should strengthen industry self-discipline, standardize industry behavior, formulate and improve industry service standards, promote standardized services, advocate honest management, and safeguard the legitimate rights and interests of property service enterprises.

City Property Service Industry Association shall establish a unified list of the city's property service project managers and registered property managers and other related professional service personnel, and provide inquiries to the society.

Chapter VII Legal Liability

Sixty-seventh acts in violation of the provisions of these measures, laws, regulations and other rules have been punished, in accordance with its provisions; Where there are no penalties, the provisions of these Measures shall apply.

Article 68 If the owners' committee or members of the owners' committee violate the provisions of the second paragraph of Article 27 and the third paragraph of Article 28 of these Measures and refuse to hand over relevant materials and property in time, the neighborhood offices and township (town) people's governments where the property management area is located shall order them to make corrections within a time limit.

Article 69 Where a realty service enterprise violates the provisions of Article 34 of these measures and fails to handle the formalities for filing the realty service contract in time, the county (city) and district housing security management department shall order it to make corrections within a time limit and record the violations in the credit files of the realty service enterprise; If no correction is made within the time limit, the urban management law enforcement department shall impose a fine of one thousand yuan.

Article 70 If a realty service enterprise refuses to handle the handover after the owners' meeting decides to hire a new realty service enterprise in violation of the provisions of the second paragraph of Article 42 of these measures, the county (city) and district housing security management department shall order it to make corrections within a time limit and record its illegal acts in the credit files of realty service enterprises; If no correction is made within the time limit, the urban management law enforcement department shall impose a fine of one thousand yuan.

Article 71 Where the staff of the housing security management department, sub-district offices, township (town) people's governments and other relevant departments misappropriate the property quality warranty fund or the property special maintenance fund in their work, or take advantage of their positions to accept other people's property or other benefits, the supervisory organ shall punish them according to law; If a crime is constituted, criminal responsibility shall be investigated according to law.

If the staff of other state organs fail to perform their duties of supervision and management of property management activities according to law, or fail to investigate and deal with the complained illegal acts, resulting in adverse effects, the supervisory organs shall give sanctions according to law; If a crime is constituted, criminal responsibility shall be investigated according to law.

Chapter VIII Supplementary Provisions

Article 73 These Measures shall come into force as of February 1 day, 2065. The property management measures of Jinan Municipal People's Government149) shall come into force on July 30th, and 1999 shall be abolished at the same time.
