Provisions of Zhangzhou Municipality on the Administration of Public Parking Lot

Article 1 In order to strengthen the management of urban public parking, reasonably guide the parking demand, standardize the parking order and improve the urban traffic environment, these Provisions are formulated in accordance with the Urban and Rural Planning Law of People's Republic of China (PRC), the Law of the People's Republic of China on Road Traffic Safety and other relevant laws and regulations, and combined with the actual situation of this Municipality. Article 2 These Provisions shall apply to public parking management activities in urban built-up areas within the administrative area of this Municipality and in areas where the people's governments of cities and counties (cities) decide to implement urbanization management.

The specific scope of urban built-up areas and urbanization management areas shall be determined by the people's governments of cities and counties (cities) and announced to the public. Article 3 The term "public parking management" as mentioned in these Provisions refers to public parking planning, parking facilities construction, public parking order, parking fees and other activities related to motor vehicle parking.

The parking facilities mentioned in these Provisions include public parking facilities, special parking facilities, on-street parking spaces and temporary parking facilities. Among them, public parking facilities refer to motor vehicle parking places open to the public in public buildings built according to the plan or supporting construction; Special parking facilities refer to the places where motor vehicles are parked in this unit and this residential area; On-street parking spaces refer to motor vehicle parking places set up in accordance with the law on urban roads; Temporary parking facilities refer to places for temporary parking of motor vehicles set up by using idle land, public squares and municipal planning areas that have not been handed over. Article 4 Public parking management shall follow the principles of government leading, planning leading, supporting construction and effective management, and form a comprehensive urban public parking system with public parking facilities as the main body and special parking facilities, on-street parking spaces and temporary parking facilities as the supplements. Fifth city and county (city, district) people's governments shall establish a comprehensive coordination mechanism to study and solve the problems of public parking management.

The traffic management department of the public security organ is the competent department of urban public parking management.

The competent department of housing and urban and rural construction is responsible for the supervision and management of the construction of public parking facilities.

The competent department of urban and rural planning is responsible for the planning and approval of public parking facilities.

The competent department of land and resources is responsible for the supply of land for public parking facilities.

The functional departments of development and reform, finance, transportation, urban management, administrative law enforcement, price control and fire control shall, according to their respective duties, do a good job in public parking management according to law.

Street offices, township (town) people's governments and community committees shall cooperate with each other to do a good job in the management of public parking within their respective jurisdictions. Article 6 The competent department of urban and rural planning of a city or county (city) shall, jointly with the traffic management, development and reform, housing and urban and rural construction, transportation and other departments of the public security organ at the same level, formulate a special plan for urban public parking facilities in accordance with the overall urban planning and comprehensive urban traffic planning, and in combination with the needs of urban construction and development and road traffic safety management, and implement it after being approved by the people's government at the same level. Seventh city, county (city) people's government shall, according to the special planning of urban public parking facilities, arrange land for the construction of public parking facilities.

Public parking facilities construction land in line with the allocation of land directory, can be allocated to supply; Do not meet, should be taken to sell, lease supply.

Under the premise of conforming to the overall land use planning and urban planning, organs, enterprises and institutions are encouraged to use their own construction land to build public parking facilities, without changing the nature of existing land and planned land. With the approval of the people's government of the city or county (city), the land reserved by the government can be temporarily used as public parking facilities.

Under the premise of conforming to the overall land use planning and urban planning, with the approval of the people's governments of cities and counties (cities), rural collective economic organizations may use collective construction land to build public parking facilities according to law. Eighth to encourage social capital to participate in the construction of public parking facilities; Encourage the comprehensive utilization of underground space and other resources to build public parking facilities.

Encourage public institutions, enterprises and institutions, and special parking facilities in residential quarters to open to the public in different periods and provide operating parking services on the premise of meeting the parking needs of their own units and owners. Article 9 On-street parking spaces shall be set up or removed by the traffic administrative department of the public security organ in accordance with the principle that motor vehicle traffic safety is compatible with smooth roads, in conjunction with urban and rural planning, urban management administrative law enforcement, transportation and other departments. If the parking berth is dismantled, the traffic administrative department of the public security organ shall dismantle the traffic markings in time and restore to the original state. Any other unit or individual shall not set up, damage or dismantle the on-street parking spaces and signs and markings, or interfere with the parking function of the on-street parking spaces, or use the on-street parking spaces for other purposes.

The traffic administrative department of the public security organ shall, jointly with urban and rural planning, urban management administrative law enforcement, transportation and other departments, fully listen to the opinions of relevant units and citizens when setting up or removing roadside parking spaces. Tenth the following sections prohibit the setting of road parking spaces:

(a) strict control of street traffic, urban traffic core area of the main road motor vehicle lane;

(2) Blind roads, fire exits, medical rescue exits and evacuation exits near large public buildings;

(three) public transport stations, first aid stations, gas stations, fire hydrants or fire brigades (stations) around the road within 30 meters;

(4) Crossroads, railway intersections, sharp detours, narrow roads, bridges, steep slopes, tunnels with a width less than four meters, and sections within fifty meters around the entrances and exits of schools and hospitals;

(five) set up parking facilities within 200 meters around the public roads (except the parking facilities built by buildings);

(six) other prohibited circumstances stipulated by laws and regulations.
