Legal analysis: Generally speaking, the owner can't refuse to pay the property management fee on the grounds that he is not satisfied with the property service. If the services provided by the property management company have seriously violated the agreement, the owner can file a separate lawsuit for breach of contract. If the court confirms that the property service is defective, it will reduce the property service fee according to the agreement in the property service contract. If there is no agreement between the two parties in the property service contract, the court will make a comprehensive balance and reduce it as appropriate.
Legal basis: Article 41 of the Regulations on Property Management, the owner shall pay the property service fee according to the agreement in the property service contract. If the owner and the user of the property agree that the user of the property shall pay the property service fee, the owner shall bear joint and several liability from the agreement. Property that has been completed but has not been sold or handed over to the property buyer shall be paid by the construction unit.
