Regulations of Jilin Province on Property Management
The term "property management" as mentioned in these Regulations refers to the activities that the owners carry out maintenance, conservation, management and maintenance of environmental sanitation and related order in the buildings, structures and their supporting facilities and equipment and related sites within the property management area through self-management or entrusting property service personnel with decision-making. Property service providers include property service enterprises and other managers. Article 3 Property management should be incorporated into the community governance system, and a working pattern of party building leading, government leading, industry self-discipline, residents' autonomy, professional services, multi-party participation and consultation should be established. Fourth people's governments at or above the county level shall strengthen the organization and leadership of property management, establish and improve the comprehensive coordination mechanism and target responsibility system of property management; Improve support and incentive policies and measures, and establish corresponding capital investment and guarantee mechanisms; Encourage the adoption of new technologies and methods, and use information technology to improve property management and service quality. Article 5 The property administrative departments of the people's governments at or above the county level shall be responsible for the supervision and management of property management activities within their respective administrative areas, and perform the following duties according to law:
(a) to formulate policies and measures related to property management;
(two) to guide the neighborhood offices and Township People's governments to supervise and manage the property management activities;
(three) to guide the neighborhood offices and Township People's governments to mediate property management disputes;
(four) to establish and improve the property service standards and quality assessment system;
(five) to establish and improve the credit management system of property services;
(six) to establish and improve the electronic information platform for property management;
(seven) supervision and management of property bidding activities;
(eight) supervision and management of buildings and ancillary facilities maintenance funds (hereinafter referred to as special maintenance funds) deposit and use;
(9) Organizing training related to property management;
(ten) the implementation of other property management supervision and management responsibilities stipulated by laws and regulations. Article 6 Sub-district offices and Township People's governments shall be responsible for the guidance, supervision and management of property management activities within their respective administrative areas, and shall perform the following duties according to law:
(1) Organizing the establishment of the preparatory group for the first owners' meeting;
(two) to guide and assist the establishment of the owners' congress, the election and general change of the owners' committee;
(three) to guide and supervise the owners' congress, the owners' committee and the property service providers to perform their duties according to law;
(four) the implementation of supervision and inspection of property services within the property management area;
(five) to guide and supervise the property inspection and the withdrawal of the property service personnel from the handover activities;
(six) the establishment of property management disputes mediation, complaints and reports processing mechanism, mediation of property management disputes, handling complaints and reports related to property management;
(seven) to coordinate and supervise the property management of old residential areas;
(eight) the implementation of other property management supervision and management responsibilities stipulated by laws and regulations. Seventh neighborhood (village) committees shall assist neighborhood offices and township people's governments to do specific work related to property management, guide and supervise the owners' assembly, owners' committee and property service providers to perform their duties according to law, and mediate property management disputes. Promote the establishment of party organizations by owners' committees and property service enterprises.
Encourage and support China party member, members of the owners' committee and the person in charge of property projects, and serve as part-time members of community party organizations; Eligible community party organizations and members of neighborhood committees also serve as members of the owners' committee through legal procedures.
Establish and improve the deliberation and coordination mechanism of community party organizations, neighborhood (village) committees, owners' committees and property service providers. Article 9 Owners shall abide by laws and regulations, carry forward and practice socialist core values, exercise their rights and perform their obligations according to law, and shall not violate public order and good customs or harm public interests. Tenth property management industry associations should strengthen industry self-discipline, standardize business practices, promote the standardization of property services, maintain market order and fair competition, and promote the healthy development of the property management industry. Eleventh during the emergency response, the property service provider shall implement the emergency measures implemented by the people's governments at or above the county level according to law, and actively cooperate with relevant work, and the people's governments at or above the county level shall give necessary material and financial support.
Owners and property users shall cooperate with property service providers to implement various emergency measures implemented by the government according to law. Twelfth people's governments at or above the county level property administrative departments, neighborhood offices, Township People's governments should be through newspapers, radio, television, Internet and long-term publicity in a prominent position in the property management area, etc., to organize publicity of property management laws and regulations.
