Interim Measures of Xuzhou Municipality on the Administration of Delivery and Use of Urban Real Estate Development Residential Projects

Article 1 In order to strengthen the management of the delivery and use of urban real estate development residential projects and ensure the overall residential function and quality of residential buildings, these Measures are formulated in accordance with the Law of People's Republic of China (PRC) Municipality on Urban Real Estate Management, the Regulations on the Management of Urban Real Estate Development and Operation and other relevant laws and regulations, and in combination with the actual situation of this Municipality. ? Article 2 These Measures shall apply to the delivery, use, supervision and management activities of Xuzhou real estate development residential projects (hereinafter referred to as residential projects). ? Article 3 The municipal construction administrative department shall be responsible for organizing and coordinating the supervision and management of the delivery and use of residential projects. City planning, land, real estate, municipal, garden, public security, city appearance and other relevant departments, in accordance with their respective responsibilities, do a good job in the supervision and management of the delivery of residential projects. ?

District People's Government and its sub-district offices, urban water supply, power supply, gas supply and other units shall cooperate with the delivery and use management of residential projects. Article 4 Residential projects shall build public facilities and public service facilities (hereinafter referred to as supporting facilities) according to the requirements of land use right transfer conditions and planning conditions. Supporting facilities should be built and delivered simultaneously with the residence. ?

When residential projects built by stages are delivered by stages, supporting facilities shall meet the basic needs of residents. ? Fifth real estate development enterprises shall, according to the conditions for the transfer of land use rights and the contents of the planning permission of construction projects, prepare the construction plan of residential projects. The residential project construction plan shall include the following main contents:

(a) the basic situation of residential project construction; ?

(two) the construction content and standards of residential buildings and their supporting facilities; ?

(three) the construction schedule and safeguard measures of supporting facilities; ?

(four) the definition of property rights of supporting facilities; ?

(five) residential projects built by stages, the regional boundaries of each stage and the content and timing of supporting facilities construction. ? Article 6 The municipal construction administrative department shall, jointly with the municipal planning, land, municipal administration, real estate, gardens, city appearance, public security and other departments, form a coordination office for supporting the construction of residential projects, which shall be responsible for guiding the supporting construction of residential projects, studying major issues of supporting the construction of residential projects, coordinating related matters of supporting the construction of residential projects, and formulating a demonstration text of the construction scheme of residential projects. ? Seventh real estate development enterprises shall submit the construction plan of residential projects to the municipal construction administrative department before submitting the construction drawings for review. The municipal construction administrative department shall, jointly with the planning and land administrative departments, review the construction plan. If the construction drawing does not conform to the provisions of these measures, the construction drawing design documents shall not be approved. ? Eighth real estate development enterprises should publicize the construction plan when pre-selling (selling) commercial housing. Ninth municipal construction administrative departments shall supervise the quality of supporting facilities construction projects, and incorporate the implementation of supporting facilities into the construction plan of quality supervision report. ? Article 10 The delivery of residential projects shall meet the following conditions:

(a) the unit project completion acceptance, completion acceptance for the record; ?

(two) domestic water into the city water supply network; ?

(3) discharging rainwater and sewage into the urban rainwater and sewage drainage system; ?

(four) residential electricity and residential management electricity into the city power supply network; ?

(five) the road construction in the residential area conforms to the planning requirements and quality grade standards, and has a standardized road connection with the external traffic trunk roads, and completes the corresponding road lighting facilities according to the design requirements; ?

(six) conditional areas, the completion of gas pipeline laying, household pipeline with opening conditions; ?

(seven) in accordance with the construction plan to complete the greening of residential areas, due to seasonal reasons, it should make a commitment to the municipal garden department to implement safeguard measures; ?

(eight) the realty service enterprise and the realty service house have been implemented; ?

(nine) in accordance with the construction planning and construction of community service, public security, sanitation and other supporting service facilities have been completed; ?

(ten) in accordance with the construction plan supporting the construction of telecommunications, cable television, postal and other facilities have been completed; ?

(eleven) all the compensation and resettlement for demolition are in place; ?

(twelve) other conditions stipulated by laws, regulations and rules. ? Article 11 Where a residential project conforms to the provisions of Article 10 and a real estate development enterprise applies to the municipal construction administrative department for delivery and acceptance, the municipal construction administrative department shall, within five working days from the date of receiving the application, notify the relevant administrative departments and units in writing to organize the acceptance. The relevant administrative departments and units shall, within ten days from the date of receiving the notice of acceptance, organize individual acceptance according to their respective responsibilities, and issue a certificate of eligibility to the real estate development enterprise within five working days after acceptance; Unqualified, it shall inform the reasons in writing. Failing to organize acceptance or issue a certificate of conformity within the time limit without justifiable reasons shall be deemed as qualified. ?

The relevant administrative departments and units shall conduct acceptance according to the contents determined in the construction drawings, and shall not increase the contents and conditions of acceptance without authorization, and shall not charge fees. Except as otherwise provided by laws and regulations. ? Twelfth real estate development enterprises to the municipal administrative department of construction to apply for the delivery of residential projects, shall submit the following relevant documents or certificates:

(a) the completion acceptance record form issued by the municipal construction administrative department and the certificate that the demolition compensation and resettlement have been implemented; ?

(two) the acceptance documents issued by the municipal planning administrative department to fully implement the planning conditions; ?

(three) the certificate issued by the municipal public sector that the water supply, gas, drainage, roads and lighting facilities are allowed to be delivered; ?

(four) the certificate issued by the municipal garden department that meets the greening standards and delivery conditions, or the opinion of agreeing to put it into use; ?

(five) the certificate issued by the municipal real estate management department that the property service house and the property service enterprise have been implemented; ?

(six) the certificate issued by the power supply unit that the domestic and management electricity consumption has been included in the urban power supply network; ?

(seven) the certificate issued by the municipal public security department that the safety precautions conform to the construction plan; ?

(eight) the community housing and sanitation facilities issued by the street office in accordance with the requirements of the construction plan have been handed over;

(nine) other supporting facilities determined in accordance with the construction plan have been completed. ?
