The owners' committee is a private legal person with no business license and organization code certificate, while the property management company is owned by the enterprise. In China, government agencies, people's organizations and private legal entities do not have business licenses and organization code certificates, because these units are not enterprises or profit-making units.

Institutions, people's organizations and private legal persons can exercise the right to sign economic contracts as long as they have the record certificates of relevant government departments. When the property service contract signed between the property company and the owners' committee is filed with the local housing management department and the price department, the property company needs to issue a business license, a tax registration certificate and an organization code certificate.

Article 7 A company established according to law shall be issued a business license by the company registration authority. The date of issuance of the business license of the company is the date of establishment of the company.

The company's business license shall specify the company's name, domicile, registered capital, business scope, name of legal representative and other matters.

Where the matters recorded in the company's business license change, the company shall register the change according to law, and the company registration authority shall issue a new business license.
