Second-hand housing property delivery encounters chronic diseases? This is the prescription

Property delivery is an important step in the second-hand housing transaction, but it is also a very complicated step, because it involves the settlement of various expenses and the verification of a large amount of information. In case the owner does not pay the fee, it will really add fuel to the fire. Today, I will give you some prescriptions for intractable diseases in the process of property delivery.

1. What if the original owner owes the property fee?

There are three main solutions:

The first one is to keep a part of the house payment as the property delivery deposit when paying the house payment, and then deliver the money to the original owner until the property delivery is successfully completed. If the original owner maliciously defaults on the property fee, he can directly use this property delivery deposit to pay the outstanding property arrears.

The second method is to find an intermediary. Since most second-hand houses are traded through intermediaries, you can ask the intermediary to pay in advance, and then let the intermediary go to the original owner to recover the property fee. However, this method is ideal because only a few intermediary companies can do it.

The third is to refuse to pay according to law. According to the Measures for the Administration of Property Service Charges, when the property right is transferred, the owner or property user shall settle the property service fee or property service fund. In other words, as long as there is no special agreement on unpaid property fees in the sales contract, the fees will be borne by the original owners.

Second, the property company has the right to cut off water and electricity if the owner fails to pay the utilities?

If the owner does not pay the water and electricity bills, the property management company will generally take measures to cut off water and electricity, but is this legal? This needs to be discussed in two situations:

(1) If the water supply and power supply company entrusts the property company to collect water and electricity charges, when the owner fails to pay the water and electricity charges, the property company can take measures to cut off water and electricity in the name of the water supply and power supply company.

(2) If the water supply and power supply company fails to entrust the property company to collect water and electricity charges, the property company cannot take measures to cut off water and electricity. If water supply and power failure cause losses to the owner, the owner may claim compensation from the property company.

Third, if the property service is poor, how should the owners protect their rights?

The relationship between the property company and the owner is a property service contract. If the property service is poor, the owner can solve it in four ways.

The first is to directly ask the property management company to improve the service quality; The second is to report to the owners' committee of the community, and the owners' committee will come forward to negotiate with the property company or request the replacement of the property company; The third is to complain to the local property office; The fourth is to solve it through litigation.
