Since the second half of 2065438+2009, many cities have introduced similar new real estate regulations. For example, according to the report of Metropolitan Express, Shanxi and other provinces will cancel unreasonable property fees according to the new property regulations, such as utilities, energy consumption, garbage disposal fees and so on.
According to the new regulations of Shenzhen, from March 2020, all the operating income of the public area of the community must be owned by all the owners.
Community owners will obtain a unified credit code in the form of industry committees to open public accounts, and public benefits will be managed by all owners of the community to avoid personal enrichment of property companies.
In addition, from May 1 2020, there will be a regulation in Chongqing, that is, "real estate enterprises shall not breach the contract, lower the service level of real estate or increase fees without authorization".
This will enable some real estate companies to control "multiple ways" and "channels" to charge excessive property fees to community owners, so that they can pay less.
In short, the implementation of the "new rules" will no longer need these three expenses.
1. Property service fee for public areas.
Many people don't understand that it is necessary to maintain green vegetation in residential areas with bright lights day and night. Aren't these utilities shared by the owners? It is precisely because many people don't understand the content of "property fee" that there are loopholes in the property, and many informal real estate companies take the opportunity to charge the owners of the community for the increase of "public water and electricity sharing fee".
However, according to the property management regulations, the monthly property fee paid by the owner already includes the daily maintenance fee, daily water and electricity fee, garbage disposal and other ward fees, so there is no need to pay these fees repeatedly.
2. Fees charged to the property in violation of the contract.
Residential owners entrust property companies to provide property services, and owners pay property fees every month, which is the relationship between service buyers and service providers.
Both parties must sign a real estate service contract in accordance with China Contract Law. The contract must specify the service content, items and charging standards, and be based on the performance of rights and obligations of both parties.
The basic constraint of a contract is that it is not allowed to provide services or pay fees not specified in the contract.
If the owner lowers the service standard or increases the cost, the owner can not sign a contract with him and not pay.
3. The owner does not need to pay the management fee of the public area, but the income belongs to the owner.
Real estate is a big cake to taste, especially for developers. No matter how small the real estate company is, it makes more money. There are 16 trillion real estate companies in China, with a total of more than 65,438+10,000 real estate companies and more than 7 million real estate employees, but only more than 20 companies have improved their quality through service quality, and more than 90% of the real estate companies have been assigned to the scheme, which shows that they are not doing well enough.
This means that more than 90% of real estate companies are unqualified.
Can I claim the management fee for public areas? According to the Property Law, the public areas with houses belong to the shared owners, but they don't need to be returned, because the public areas have already paid the property fees.
On the other hand, according to the Property Law, the owner has the right to get benefits from the area he owns according to law.
This means that the owners have the right to obtain the operating income of their own houses, and the operating income right of public areas belongs to all owners.
This clarifies the basic principles of royalties and income, and avoids the problem of overpaying royalties.
