Regulations of Ningbo Municipality on Gas Management

Chapter I General Provisions Article 1 In order to strengthen the management of gas, standardize the gas market, ensure the normal supply and safe use of gas, safeguard the legitimate rights and interests of gas users and gas trading enterprises, and promote the development of gas industry, these Regulations are formulated in accordance with relevant national laws and regulations and in light of the actual situation of this Municipality. Article 2 The term "fuel gas" as mentioned in these Regulations refers to natural gas, liquefied petroleum gas (hereinafter referred to as LPG), artificial gas and other gaseous fuels. Article 3 These Regulations shall apply to gas planning, gas engineering construction, gas storage, transportation, management and use, gas facilities protection, gas appliance sales, installation and maintenance, and gas safety management within the administrative area of this Municipality. Article 4 The municipal urban management department is the administrative department of gas in this Municipality and is responsible for organizing the implementation of these Regulations.

County (city), district construction (city management) administrative departments are the administrative departments of gas within their respective administrative areas.

Quality and technical supervision, public security, production safety supervision, industry and commerce, planning, environmental protection, price, transportation and other administrative departments. Should be responsible for the supervision and management of gas in accordance with their respective responsibilities. Fifth gas management should follow the principles of overall planning, supporting construction, franchising, safety first and convenience for users.

Promote the use of gas, promote the development of pipeline gas, promote clean energy, promote scientific and technological progress, and protect and improve the atmospheric environment. Chapter II Planning and Construction Article 6 The municipal, county (city) and district people's governments shall incorporate the development of gas industry into the national economic and social development plan.

The gas administrative department shall, according to the national industrial policy, the overall urban planning and the needs of local economic and social development, work out the gas development plan and pipeline gas construction plan in conjunction with the planning department, and link them with the provincial natural gas pipeline network planning, and report them to the people's government at the same level for approval before implementation. Article 7 The development of new areas and the transformation of old cities, and the new construction, reconstruction and expansion of large-scale construction projects shall be accompanied by the construction of gas facilities in accordance with the gas development plan and detailed regional planning, and shall be designed, constructed and accepted simultaneously with the main project. Eighth new construction, renovation and expansion of gas projects shall conform to the gas development plan. Before the project is approved, the construction unit shall obtain the gas franchise granted by the people's government of the city or county (city).

The design, construction and supervision of gas engineering shall be undertaken by units with corresponding qualifications and carried out in accordance with relevant national technical standards and norms. Ninth gas engineering construction equipment and materials, shall comply with national standards or industry standards. Article 10 No unit or individual may obstruct the construction and installation of approved gas projects. Eleventh after the completion of the gas project, the construction unit shall establish a complete technical file and report it to the gas administrative department for the record. Chapter III Operation and Use Article 12 The franchise system shall be implemented for gas operation.

Enterprises operating city gas shall obtain the gas franchise right granted by the Municipal People's Government; Enterprises engaged in gas in counties (cities) shall obtain the gas franchise granted by the local county (city) people's government. Thirteenth gas franchise shall be awarded by tender.

Bidding shall be conducted in accordance with the Bidding Law of People's Republic of China (PRC) and other relevant laws and regulations. After winning the bid, the gas administrative department shall, on behalf of the people's government at the corresponding level, sign a gas franchise contract with the enterprise that has obtained the franchise right. Fourteenth gas franchise contracts generally include the following contents:

(a) business content and duration;

(2) Quality standards of products and services;

(3) Methods and standards for pricing or charging;

(4) Asset management system;

(5) Rights and obligations of both parties;

(6) Performance guarantee;

(seven) the termination and change of management rights;

(8) supervision mechanism;

(9) Safety responsibilities;

(10) Liability for breach of contract. Fifteenth enterprises applying for gas franchise shall meet the following conditions:

(a) its factory (station, point) is set in line with the gas development plan;

(2) Having a long-term and stable gas source that meets the quality standards;

(3) Having funds and production, service, management and engineering technicians suitable for the scale of operation;

(4) Having gas supply facilities such as storage, distribution and filling. Comply with relevant safety technical specifications and adapt to the development scale of users;

(5) Having emergency handling capacity, necessary equipment and facilities, transportation, communication and other tools suitable for the supply scale;

(6) Other conditions stipulated by laws and regulations. Sixteenth gas supply stations, storage and distribution (irrigation) stations, gasification stations, gate stations, pressure regulating stations and operating motor vehicle filling stations shall be set up by enterprises that have obtained gas franchise rights in accordance with the design specifications for urban gas. Seventeenth hotels, restaurants, canteens, etc. A, because of their own production and living needs, the establishment of bottle group station, should meet the following conditions:

(a) meet the standards of fire and explosion prevention, and implement the responsibility system for production safety;

(2) Having a group of bottles that meet the safety standards;

(3) The management and use of gas cylinders and other facilities conform to relevant professional specifications.

If the existing bottle group station does not meet the conditions specified in the preceding paragraph, it shall be rectified within a time limit.
