It is easy for workers to resign. Workers only need to notify the employer 30 days in advance (3 days in advance of the probation period), and they can leave when the time comes. The employer's consent is not required. Workers are required to fulfill their notification obligations.

1. There are three situations in which an individual proposes to resign:

1. The employer has circumstances under Article 38 of the Labor Contract Law, and you can leave immediately after you propose in writing to terminate the labor relationship. Approval from the employer is not required, and the employer may be required to pay the remaining wages and economic compensation (one month’s salary for each year of work) and go through resignation procedures;

2. In accordance with the "Labor Contract Law" Article 37: If you submit a written resignation 30 days in advance, you can resign without the approval of the employer. Among them, the probation period must be submitted in writing 3 days in advance; the employer is obliged to settle the salary and go through the resignation procedures.

3. You did not submit your resignation 30 days in advance, and the employer does not fall under Article 38 of the Labor Contract Law. If you directly submit your resignation letter and leave, you are breaking the law at this time, and you will be punished by the employer. The employer can require you to bear the direct economic losses caused and the expenses incurred by recruiting you.

2. You can mail the employer’s notice of termination of the labor relationship (also known as resignation letter or resignation report) by express delivery or registered mail, so as to facilitate the retention of evidence. If the employer fails to pay you wages or handle resignation procedures for you, you can resolve the issue by applying for labor arbitration;
