Regulations of Changsha Municipality on the Administration of Outdoor Advertising

Chapter I General Provisions Article 1 In order to strengthen the management of outdoor advertising, standardize outdoor advertising activities, promote economic development and beautify the city, these Regulations are formulated in accordance with the provisions of the Advertising Law of People's Republic of China (PRC), the Regulations on Advertising Management and other relevant laws and regulations, combined with the actual situation of this Municipality. Article 2 All units and individuals engaged in outdoor advertising activities within the administrative area of this Municipality shall abide by these regulations. Article 3 Outdoor advertising as mentioned in these Regulations refers to commercial advertisements in which commodity operators or service providers directly or indirectly introduce the commodities or services they sell through the following media and forms, and bear the expenses:

(a) the use of public or owned venues, spaces, buildings, hanging signs, neon lights, electronic display boards (screens), light boxes, windows, three-dimensional modeling, banners and other advertisements.

(two) the use of vehicles to set up, draw and post advertisements;

(3) Advertisements set up, drawn, hung and posted outdoors in other forms. Article 4 The release of outdoor advertisements shall comply with the provisions of the Advertising Law of People's Republic of China (PRC), and the contents shall be true, lawful and civilized, and shall not harm the dignity of the state and the nation, and shall not deceive or mislead consumers. Article 5 The administrative department for industry and commerce of the Municipal People's Government is the supervision and administration organ of outdoor advertising in this Municipality, and the administrative department for industry and commerce of the county (city) people's government is responsible for the supervision and administration of outdoor advertising within its jurisdiction. Chapter II Planning and Setting Article 6 The planning of outdoor advertising shall be subject to urban planning, and shall be formulated by the municipal and county (city) people's governments in charge of advertising supervision and management, urban construction, environmental protection, public security and other departments, and the administrative department for industry and commerce shall be responsible for supervising the implementation. Seventh use of municipal public facilities, public places to set up outdoor advertising, the implementation of paid use, public auction system. The specific measures shall be formulated by the Municipal People's Government in accordance with the relevant provisions of the state. Eighth outdoor advertising settings shall meet the following requirements:

(two) outdoor advertising text, language norms, the unit of measurement in line with national standards;

(three) the design, production and installation of outdoor advertising facilities meet the safety requirements and the corresponding technical and quality standards;

(four) outdoor advertising set above the city roadway, the height of the bottom of the facility from the ground shall not be less than 4.5 meters; The height of outdoor advertisements above the sidewalk shall not be less than 2.8 meters from the ground; Outdoor advertisements installed on the walls of buildings shall not be more than 1.5m away from the walls. Ninth in any of the following circumstances, outdoor advertising shall not be set up:

(a) the use of traffic safety facilities, traffic signs;

(2) Affecting the use of municipal public facilities, traffic safety facilities and traffic signs;

(three) hinder production or public life, damage the city or landscaping;

(four) the construction control zone of state organs, cultural relics protection units and scenic spots;

(five) the people's governments at or above the county level are prohibited from setting up outdoor advertising areas. Tenth outdoor advertisements shall be inspected, repaired and maintained by publishers, and kept clean, beautiful and safe. Chapter III Application for Registration Article 12 Anyone who sets up or publishes outdoor advertisements must apply to the administrative department for industry and commerce for registration. It shall not be established or published without registration. Thirteenth to apply for outdoor advertising registration, the following documents shall be submitted:

(a) business license or advertising business license;

(two) documents confirming the authenticity of the advertising content and the quality inspection of the goods;

(three) advertising contracts, advertising design samples, outdoor advertising facilities design and construction drawings;

(four) the certificate of the right to use or the certificate of ownership obtained by auction, and the agreement on the use of the site and facilities.

Where the location of outdoor advertising needs to be examined by the relevant administrative departments in accordance with the provisions of laws and regulations, the examination documents issued by the relevant administrative departments shall be submitted.

When publishing outdoor advertisements of drugs, medical devices, pesticides, veterinary drugs, tobacco and other commodities, and other outdoor advertisements that should be examined by the relevant competent departments according to laws and regulations, the examination documents for the contents of advertisements must be provided at the time of registration.

If the required supporting documents are not submitted, the administrative department for industry and commerce shall not handle the registration. Article 14 The administrative department for industry and commerce shall make a decision within seven days from the date of accepting the application for outdoor advertising registration, and issue the Outdoor Advertising Registration Certificate to those who meet the requirements after examination; For those who do not meet the requirements, give the applicant a written reply and return the relevant documents and materials.

The administrative department for industry and commerce shall keep business secrets in the registration and management of outdoor advertisements. Fifteenth outdoor advertisements registered and released shall be marked with the standard registration number and the name of the publisher. Sixteenth kinds of fairs, orders, fairs, sports meetings and other activities need to set up temporary outdoor advertising, it shall apply to the administrative department for Industry and commerce, and it shall be set up after approval. Chapter IV Supervision and Administration Article 17 Outdoor advertisements must be published in accordance with the approved contents, locations, forms, specifications and time.
