Settlement of sick leave wages by Bijie Tobacco Company in 2016
To calculate sick leave pay, we must first determine two variables, one is the calculation base of sick leave pay, and the other is the calculation coefficient of sick leave pay.
1. The base amount of sick leave pay is determined according to the following three principles:
(1) If there is a stipulation in the labor contract, the base amount shall be no less than the employee’s position as stipulated in the labor contract ( Position) corresponding salary standards are determined. If the standards set by the collective contract (collective wage agreement) are higher than the standards agreed in the labor contract, the standards shall be determined by the standards of the collective contract (collective wage agreement).
(2) If there is no agreement in the labor contract or collective contract, the employer and employee representatives can determine the wage through collective negotiation. The result of the negotiation should be a collective wage agreement.
(3) If there is no agreement between the employer and the employee, the calculation base for holiday pay shall be determined based on 70% of the employee’s normal monthly salary for his/her position (position). In addition, the holiday wage base calculated according to the above three principles shall not be lower than the minimum wage standard stipulated by this city.
2. The calculation coefficient is determined in the following way:
(1) If an employee’s continuous leave due to illness or non-work-related injury is within 6 months, the enterprise shall pay the sick leave according to the following standards Salary: ① If the continuous service is less than 2 years, it will be calculated as 60% of the salary; ② If the continuous service is more than 2 years but less than 4 years, it will be calculated as 70% of the salary; ③ If the continuous service is more than 4 years but less than 6 years, it will be calculated as 70% of the salary. 80% of my salary will be paid; ④ If the employee has worked continuously for 6 years but less than 8 years, 90% of the employee’s salary will be paid; ⑤ If the employee has worked continuously for 8 years or more, 100% of the employee’s salary will be paid.
(2) If an employee has a disease or non-work-related injury and takes leave for more than 6 months in a row, the enterprise will pay the disease relief fee: ① If the employee’s continuous service is less than 1 year, it will be calculated as 40% of the employee’s salary; ② If the employee has worked continuously for 1 year but less than 3 years, he or she will be paid based on 50% of his or her salary; ③ If the employee has worked continuously for 3 years or more, he or she will be paid at the rate of 60% of his or her salary.
After the calculation base and calculation coefficient of sick leave pay are determined, the amount of sick leave pay can be calculated. Sick leave pay = (calculation base/21.75) × calculation coefficient × number of sick leave days.
