The public security organ exercises the power of administrative punishment. Exit and entry administration law

Forty-third foreigners who commit one of the following acts are illegal employment:

(1) Working in China without obtaining a work permit and a work-related residence certificate as required;

(2) Working in China beyond the scope of work permit;

(3) Foreign students who violate the regulations on work-study programs and work in China beyond the prescribed post scope or time limit.

Article 80 Whoever illegally employs foreigners shall be fined between 5,000 yuan and 20,000 yuan; If the circumstances are serious, he shall be detained for more than five days and less than fifteen days, and shall be fined not less than five thousand yuan but not more than twenty thousand yuan.

Anyone who introduces foreigners to illegal employment shall be fined 5,000 yuan for each illegal introduction, with a total amount not exceeding 50,000 yuan; A fine of 5,000 yuan shall be imposed on each person who illegally introduces to the unit, and the total amount shall not exceed100,000 yuan; If there are illegal gains, the illegal gains shall be confiscated.

Those who illegally employ foreigners will be fined 1 10,000 yuan for each illegally employed person, and the total amount shall not exceed110,000 yuan; If there are illegal gains, the illegal gains shall be confiscated.

Article 87 If a person is fined for violating the exit and entry administration, the person to be punished shall pay the fine at the designated bank within 15 days from the date of receiving the penalty decision. If the punished person does not have a fixed residence at the place where he is located, it is difficult to execute the fine if he does not collect it on the spot, or it is really difficult to pay the fine at the designated bank at the port, he can collect it on the spot.

Article 88 Whoever violates the provisions of this Law and constitutes a crime shall be investigated for criminal responsibility according to law.
