According to the work arrangement of the Ministry of Land and Resources, satellite remote sensing monitoring will be fully covered for the first time in 21, and the inspection results will be used as the initiation of the Measures for Punishment of Violations of Land Management Regulations (Order No.15 of the Ministry of Supervision, Ministry of Human Resources and Social Security and the Ministry of Land and Resources, In order to ensure that illegal land use found in satellite remote sensing law enforcement inspection is fully investigated, reduce the proportion of illegal occupation of cultivated land, and successfully pass the law enforcement inspection and acceptance, the provincial government and jinan bureau of state land supervision decided to focus on the special rectification of illegal land use throughout the province, and comprehensively clean up and investigate the illegal land use after the satellite remote sensing law enforcement inspection in 28. The relevant matters are hereby notified as follows:

1. Fully understand the necessity of carrying out special rectification work

In recent years, all localities have thoroughly implemented a series of principles and policies of Scientific Outlook on Development, the CPC Central Committee and the State Council on strengthening farmland protection and strict land management, attached great importance to the management of land and resources, and always maintained the high-pressure situation of land law enforcement. The overall land management in our province is improving, the land use order is basically stable, and illegal land use is on the decline. The cities with a population of more than 5, in our province have basically carried out satellite remote sensing law enforcement inspections, and the awareness of managing land according to law has gradually increased, and the cases of illegal land use have decreased year by year. However, from the routine inspection in 29 and the inspection of satellite remote sensing law enforcement in 17 counties (cities, including development zones) in 18 provincial cities, the problem of illegal land use in places and vast rural areas where satellite remote sensing law enforcement inspection has not been carried out is more prominent, and the problem of illegal occupation of cultivated land in some places is more serious. After the implementation of satellite remote sensing law enforcement inspection, the proportion of illegally occupied cultivated land in some provincial cities and counties (cities) may reach the accountability standard, which must be paid great attention to.

the governments of cities and counties (cities) under the jurisdiction of all provinces should fully understand the importance and arduousness of this work with a high sense of political responsibility, face up to the problems, take the initiative to solve them, seriously organize and carry out special rectification of illegal land use, and make early mobilization, early deployment and early action; The relevant problems should be dealt with, solved and implemented as early as possible, and the treatment and rectification should be in place to ensure the smooth passing of the 29 satellite remote sensing law enforcement inspection and acceptance.

II. Scope and content of special rectification work

Governments at all levels, especially county-level governments, should organize special forces to focus on illegal land use within their administrative areas from October 28 to the end of December 29 in accordance with the unified arrangements of the provincial government and jinan bureau of state land supervision and the requirements of the Notice of the Ministry of Land and Resources on Seriously Investigating Illegal Land Use without Reporting (No.164 [29] of the Ministry of Land and Resources). The special rectification work is mainly in counties (cities), and it is necessary to enter the village and enter the factory, leaving no dead ends, focusing on verifying the legality of the project land. To clean up and check out all kinds of illegal land use, it is necessary to register and investigate case by case, to ensure that both the matter and the person are dealt with, and it is strictly forbidden to file a case, suppress the case and not investigate it, and punish it. On the premise of adhering to the law and regulations, we should seek truth from facts and treat it differently.

(1) All construction projects that do not conform to the overall land use planning and illegally occupy cultivated land, especially basic farmland, will be demolished and resumed cultivation.

(2) For illegal land use projects that conform to the overall land use planning (including the newly revised planning) or can be adjusted, the procedures for construction land should be completed promptly after being handled in place according to law.

(3) illegal land use that violates the national industrial policy and is not reported for use should be dealt with severely, such as overcapacity, repeated construction, "two high and one capital" (high energy consumption, high pollution and resource).

(4) Anyone who illegally uses land for non-agricultural construction in the name of agricultural structural adjustment and new rural construction will be severely punished.

(5) For the land that has been approved but not supplied, it is necessary to speed up the supply of land in accordance with the requirements of the Notice of Henan Provincial Department of Land and Resources on Carrying out the Special Clean-up Work of Land Approved but Not Requisitioned and Not Supplied (Yu Guo Tu Zi Fa [29] No.92) to avoid the illegal use of land that has not been supplied for use.

III. Steps of special rectification work

(1) Mobilization and deployment self-inspection stage (January-February 21). Since the date of issuance of this notice, the municipal governments under the jurisdiction of all provinces should pay close attention to the study and implementation of opinions, clarify the division of responsibilities, formulate implementation plans in light of the actual situation, and make specific arrangements for the special rectification work within their administrative areas to ensure the timely completion of tasks.

(2) inventory and rectification stage (March-April 21). Cities and counties (cities) under the jurisdiction of all provinces shall, in accordance with the scope, content and requirements of the special rectification work, carry out investigation and rectification opinions on a case-by-case basis. After the implementation plan of satellite remote sensing law enforcement inspection in 29 was issued, the parcels involved in the map spots were checked one by one to ensure that there were no omissions. Before April 2, 21, it is necessary to complete the inventory and rectification work, and submit special rectification work reports and statistical forms to the provincial government and jinan bureau of state land supervision.

(3) Inspection and acceptance stage (May 21). After the inspection and rectification work, the provincial government and jinan bureau of state land supervision will organize an inspector group to inspect and accept the special rectification work of illegal land use in cities under the jurisdiction of provinces.

IV. Requirements for special rectification work

(1) Clear responsibilities. The focus of the special rectification work is at the county level. County (city) governments should attach great importance to it, carefully organize it, and the main person in charge should take overall responsibility for the land management and utilization within their administrative areas. They should personally grasp the land law enforcement and supervision and the investigation and punishment of illegal cases, and grasp the implementation level by level, so as to make sure that illegal land use is handled and rectified in place. Where the rectification is ineffective, the effect is not good, and the illegal land use is serious, the provincial government will conduct warning interviews with the main responsible persons of the provincial cities and counties (cities) according to the Notice of the General Office of the People's Government of Henan Province on Printing and Distributing (Yu Zhengban [21] No.1).

(2) the investigation is in place. All localities should strictly follow the provisions of relevant laws and regulations, accurately grasp policies, seriously and responsibly organize and carry out special rectification work, and control the proportion of illegally occupied cultivated land in newly-added construction land within 1% within the inventory time limit. It is necessary to conscientiously implement the responsibility of land law enforcement. If the problem of illegal land use is not rectified, concealed, and the case is not investigated, the responsibility of the relevant personnel will be seriously investigated in accordance with the provisions of the Measures.
