Chapter I General Provisions Article 1 These Provisions are formulated in accordance with the Regulations of the People's Republic of China on Administrative Penalties for Public Security and the relevant provisions of the state and province, taking into account the specific conditions of Xiamen, in order to strengthen the public security management of ships and ports and maintain the order of maritime transportation and fishery production. Article 2 The coastal ports within the jurisdiction of Xiamen City, as well as all kinds of ships, crew members (fishermen) and their crew members berthing, sailing and operating in the ports shall abide by these provisions. Article 3 Public security organs at all levels or public security frontier organs are the functional departments of the people's governments at the same level to manage the security of ships in coastal ports.

The competent department of ships shall assist the public security organ or the public security frontier defense organ to implement the frontier security management of ports and ships. Chapter II Ship Management Article 4 All kinds of ships must hold all kinds of valid certificates issued by the competent department of ships before they can engage in production and operation.

Collectively and individually owned fishing boats, transport boats, agricultural and sideline boats should also apply to the public security frontier defense organs for the registration book of maritime vessels and the frontier defense register of maritime vessels. Article 5 Fishermen who have been producing or rotating production on board for a long time and have reached the age of 16 should apply for a boat-boat permit or a temporary boat-boat permit from the public security frontier organ where their permanent residence is located.

Offshore operators in non-coastal areas shall apply for temporary boat people's cards with certificates and resident identity cards issued by public security organs and production units where their permanent residence is located. Article 6 The Household Registration Book for Sailing Ships, the Frontier Registration Book for Sailing Ships, the Voyaging Boat People's Card and the Temporary Voyaging Boat People's Card shall be examined annually, and they shall be invalid without annual examination. It is strictly forbidden to forge, alter, sell, lease, transfer or replace the border defense documents of various ships and personnel at sea. Article 7 When a ship enters or exits a port, the person in charge of the ship shall take the initiative to apply for a visa at the public security frontier defense organ or its authorized visa point and accept entry-exit inspection. Article 8 All kinds of ships shall be marked with their names and numbers in accordance with regulations, and loaded according to the approved passenger and cargo quotas. Overloading, overloading and non-passenger ships are strictly prohibited. Article 9 Ships must abide by the relevant traffic safety management regulations when anchoring and sailing, and do the following work well to ensure the safety of ships, facilities and personnel.

(a) the ship navigation and berthing should be in accordance with the provisions, display signal types and release all kinds of audio and signals, to guard against collision.

(2) Ships are not allowed to anchor at bridges (dikes), bends, narrow waterways, fast-flowing areas and no-go areas.

(3) Tugboats should be towed according to the regional quota, and it is forbidden for ships to tow or climb the towing fleet to sail.

(four) small hang-ups, yachts shall not exceed the scope of the port, the city port should be strictly in accordance with the provisions of the tourist route, and speed limit.

(5) Ships carrying inflammable, explosive and other dangerous goods shall be approved by the Maritime Safety Administration and the public security department, and special ships shall be used for loading and unloading at designated places. Article 10 When a ship is renewed, rebuilt, traded, leased, transferred or scrapped, in addition to being approved by the competent department of the ship in accordance with the regulations, it shall also go through the formalities for the change and cancellation of the ship's household registration with the public security frontier defense organ; The transfer ship (fisherman) shall go through the formalities for the change and cancellation of the boat people going to sea with the public security frontier organs.

If a ship is stolen, robbed or sunk, it shall be reported to the place where the incident occurred, the original port public security frontier defense organ and the local competent department of ships. Eleventh all kinds of motorboats should be registered, numbered and issued ship certificates in accordance with the affiliation. All motorboats are certified to drive after passing the examination, and the competent authorities will bring them into the management scope.

Without the approval of the transportation, fishery, customs and frontier defense departments, no unit or individual may purchase motorboats without authorization. Twelfth all kinds of ships should conscientiously implement the captain responsibility system. According to the type of ship, tonnage and number of personnel, set up a ship security team or security personnel to be responsible for ship security, and strictly implement the "port and shipping" joint defense system. Chapter III Fishermen's Management Article 13 Crew members and fishermen (boat people) of all kinds of ships shall accept the public security management, household registration management and other border control of the public security frontier defense organs, and accept inspection and verification. Fourteenth to strengthen the public security management education for seafarers, fishermen and boat people and publicity and education on the situation, policies, legal system, safety and confidentiality. The management and education of seafarers shall be the responsibility of the competent department of ships; The management and education of fishermen (ships) of individual and collective ships shall be the responsibility of the county (district) competent department and the public security department. Fifteenth in any of the following circumstances, the relevant competent departments and public security frontier departments have the right to order them to stop going to sea.

(a) probation, parole, control personnel and medical parole, serving a sentence;

(2) Defendants in criminal cases who are under residential surveillance and released on bail pending trial, as well as criminal suspects identified by public security frontier defense organs, people's procuratorates or people's courts;

(three) unresolved economic and civil disputes, after being notified by the people's court at or above the county level, the township people's government or the competent department, the responsible person cannot go to sea;

(four) there are other acts in violation of public security management, and the public security organ considers it impossible to go to sea. Article 16 Crew members, fishermen and boat people shall strictly abide by the laws and decrees of the state and the regulations on the administration of public security of ships, ports and border defense, safeguard the safety of coastal defense, and be brave in fighting against all kinds of illegal and criminal acts such as sabotage by enemy agents at sea, smuggling, drug trafficking, speculation, smuggling and ferry transportation.
