Regulations of Bazhong Municipality on Grottoes Protection
Grottoes as mentioned in these Regulations refer to cultural relics with statues, patterns, characters and other shapes or symbols, which have been registered and announced by the administrative department of cultural relics and excavated, carved and drawn on cliff stone carvings in various historical periods. Article 3 The protection of grottoes shall follow the principles of giving priority to protection, giving priority to rescue, rational utilization and strengthening management, and the principles of scientific planning, professional management and graded protection, so as to safeguard the safety of grottoes, the historical features and the true integrity of the natural environment. Article 4 The municipal and county people's governments shall be responsible for the protection of grottoes within their respective administrative areas.
The administrative departments of cultural relics of the people's governments at the city and county levels shall be responsible for the supervision and administration of the protection of grottoes within their respective administrative areas. Urban and rural planning, land and resources, urban and rural construction, public security, finance, tourism, ecological environment, transportation, forestry, market supervision and management, religion and other administrative departments. The people's governments at the city and county levels are responsible for the protection of grottoes within their respective functions and duties.
Township (town) people's governments and sub-district offices shall assist the administrative departments of cultural relics of the people's governments at or above the county level in the protection of grottoes within their respective administrative areas. Article 5 The people's governments at the city and county levels shall incorporate the protection of grottoes into the national economic and social development plan and the development plan of cultural (cultural relics) undertakings, set up special protection funds and incorporate them into the fiscal budget. Article 6 The Municipal People's Government shall, in accordance with the prescribed authority and procedures, designate specialized agencies or special persons to be responsible for the protection and daily management of grottoes where national key cultural relics protection units and provincial cultural relics protection units are located.
City and county cultural relics protection units within one year from the date of approval and publication, the people's government approved the publication of the scope of protection of cultural relics protection units, make an explanation, establish records and files, and clarify the specialized agencies or designate special personnel to be responsible for management. Seventh organizations and individuals are encouraged to participate in the protection of grottoes in accordance with the law through donations, technical assistance and voluntary services.
Units and individuals that have made important inventions or outstanding contributions in the protection, research and publicity of grottoes shall be commended or rewarded by the municipal or county people's governments. Article 8 National key cultural relics protection units such as Nankan Grottoes, Beikan Grottoes, Xikan Grottoes, Shuining Temple Grottoes, Thousand-Buddha Rock Grottoes and Bairuxi Grottoes, which are announced as provincial cultural relics protection units, shall prepare protection plans respectively; Other grottoes should be protected according to needs.
Grottoes protection planning should be compiled, approved and published in accordance with legal authority and legal procedures, and follow relevant technical specifications and standards. Article 9 The cultural relics administrative department of the people's government at the city or county level shall, within 20 working days from the date of approval, publish the legally approved grotto protection plan on the website of the people's government at or above the county level, and publish it on the government website for a long time, so as to ensure that citizens, legal persons and other organizations can obtain the grotto protection planning information according to law. Article 10 The cultural relics administrative department of the people's government at the city or county level shall, within 30 working days from the date of approval, distribute the approved grotto protection plan to the administrative departments of urban and rural planning, land and resources, urban and rural construction, ecological environment, tourism, transportation, forestry and religion at the corresponding level.
Surveying and mapping geographic information management department shall incorporate the relevant information of grotto protection planning into the geographic information sharing platform. Article 11 Where the relevant administrative departments are involved in the protection of grottoes when compiling, examining, approving and implementing urban and rural planning, land use planning, environmental protection planning, tourism development planning, etc., they shall follow the grotto protection planning and solicit the opinions of the corresponding cultural relics administrative departments.
The protection zoning and management regulations determined by the grotto protection plan should be incorporated into urban and rural spatial control measures, and the requirements for construction intensity control should be incorporated into the detailed planning of urban and rural plots. Twelfth grottoes announced as cultural relics protection units, according to the needs of protection, can be designated outside the construction control zone of environmental coordination zone.
The environmental coordination area of the grottoes of cultural relics protection units at the county level shall be delineated by the administrative department of cultural relics of the people's government at the county level jointly with the administrative department of urban and rural planning, and announced after being approved by the people's government at the same level.
The environmental coordination area of the grottoes of cultural relics protection units at or above the municipal level shall be delineated by the administrative department of cultural relics of the Municipal People's Government in conjunction with the administrative department of urban and rural planning, and announced after being approved by the Municipal People's Government; Or with the approval of the people's government at the county level, after being reported to the Municipal People's government for approval, it shall be designated and published by the cultural relics administrative department of the people's government at the county level. The adjustment or modification of the scope of grotto protection, the construction control zone and the environmental coordination zone that have been demarcated and announced shall be carried out in accordance with the original approval procedures.
