Interim Measures of Beijing Municipality on the Administration of Commercial Billiards Activities

Article 1 In order to ensure the healthy development of billiards activities, enliven the cultural life of the masses and maintain the normal order of cultural and recreational activities, these Measures are formulated in accordance with the relevant provisions of the state and this Municipality. Article 2 These Measures shall apply to the business billiards activities within the administrative area of this Municipality. Article 3 The municipal, district and county cultural bureaus shall be responsible for the management of commercial billiards activities. Public security and industrial and commercial administrative organs at all levels shall, in accordance with these measures, assist the Cultural Bureau at the same level to manage and supervise the business billiards activities. Article 4 The establishment of billiard halls, courts and other commercial billiard places must meet the following conditions:

(a) there are suitable indoor places, in line with fire safety regulations.

(two) there are more than two standard meters and corresponding facilities, and the distance between the meters is not less than 1.5 meters.

(3) Having service facilities such as clothes storage. Article 5 The establishment of a business billiards venue must be reported and approved in accordance with the following provisions:

(a) the start-up unit or sponsor shall apply to the District and County Cultural Bureau. Approved by the district and county cultural bureau, the business billiards activity license is issued.

(two) to apply for safety review to the local public security bureau (county) with the permit for business billiards activities; Those who pass the examination will be issued with a safety certificate.

(three) to apply for a business license to the district and county administration for industry and commerce with the business billiards activity license and safety certificate.

Those who have not obtained the business billiards license, safety certificate and business license shall not engage in the business activities of business billiards. Article 6 Business units and individuals of a business billiards place (hereinafter referred to as billiards place operators) must abide by the following provisions:

(a) establish and improve the security system, equipped with ticket checking (or time charging), public security and other management personnel.

(2) Billiards gambling is prohibited. Gambling with billiards should be discouraged and stopped, and the local public security organs should be reported in time.

(3) The business hours at night shall not exceed 23: 00.

(four) implementation of accounting system, pay taxes according to law. Article 7 Personnel participating in billiards activities must abide by the following provisions:

(1) Observe the order in the venue, and do not make noise, make trouble or fight.

(two) are not allowed to use billiards gambling or gambling in disguise.

(3) Play in a civilized way and accept the management of management personnel.

Operators of billiards places who violate the above provisions should be criticized and discouraged. If the dissuasion is ineffective or seriously affects the order in the venue, it should be advised to leave until it is sent to the public security organ for legal treatment. Article 8 It is forbidden to engage in billiards activities in roads, streets, markets, street parks, lawns and other open-air public places. Article 9 The validity period of the Permit for Business Billiards Activities is one year. The operators of billiards places shall report to the district and county cultural bureaus for verification every year, and only after verification and renewal of new cards can they continue to operate. Article 10 If an operator of a billiards venue fails to carry out business activities for half a year from the date of obtaining a business license, or stops business activities for one year, it shall be deemed to be closed down, and the business license shall be revoked by the district or county cultural bureau and the administrative department for industry and commerce. Eleventh business billiards license, printed by the Municipal Bureau of culture; Safety certificate, printed by the Municipal Public Security Bureau. Twelfth cultural, public security, industrial and commercial administrative organs and managers at all levels should conscientiously perform their duties and regularly inspect, supervise and guide billiards places. Thirteenth any of the following acts, by the municipal, district and county cultural bureau depending on the seriousness of the case, given a warning, a deadline to correct, suspend business for rectification, confiscate the illegal income, and impose a fine of 5000 yuan. Whoever commits the above acts, if the circumstances are particularly serious, shall be punished according to the above provisions, and the license for business billiards shall be withdrawn by the Cultural Bureau, and the business license shall be revoked by the administrative department for industry and commerce. Article 14 If the operators of billiards places gather people to gamble or provide conditions for gambling, the public security organs shall ban the business places according to law and investigate and deal with them in accordance with the Regulations of the People's Republic of China on Administrative Penalties for Public Security; If the case constitutes a crime, it shall be submitted to judicial organs for criminal responsibility according to law.

In violation of the provisions of article eighth of these measures, which affects traffic and hinders social order and public safety, all illegal gains shall be confiscated and banned by the public security organs. Fifteenth problems in the specific implementation of these measures shall be interpreted by the Municipal Bureau of Culture.
