Regulations of Chongqing Municipality on Safety of Special Equipment

Chapter I General Provisions Article 1 These Regulations are formulated in accordance with the Law of the People's Republic of China on the Safety of Special Equipment and other relevant laws and administrative regulations, combined with the actual situation of this Municipality, in order to strengthen the safety of special equipment, prevent accidents of special equipment, safeguard personal and property safety, promote the construction of ecological civilization and promote economic and social development. Article 2 These Regulations shall apply to the production (including design, manufacture, installation, renovation and repair), operation, use, inspection and testing of special equipment and the safety supervision and management of special equipment within the administrative area of this Municipality.

Special equipment includes boilers, pressure vessels (including gas cylinders), pressure pipes, elevators, lifting machinery, passenger ropeways, large amusement facilities and special motor vehicles in the field (factory). The specific scope of special equipment is determined according to the catalogue of special equipment approved by the State Council. Article 3 The safety work of special equipment shall adhere to the principles of safety first, prevention first, energy conservation and environmental protection, and comprehensive management.

The city has established a special equipment safety working mechanism in which the production, operation and use units are responsible, the government and its relevant departments supervise according to law, inspection and testing institutions provide technical support, industry associations provide self-discipline services, and the public participates in supervision. Article 4 The people's governments of cities, districts and counties (autonomous counties) shall strengthen their leadership over the safety work of special equipment, incorporate the safety work of special equipment into the safety production planning and annual safety production target assessment of the people's governments at the corresponding levels, ensure the funds needed for the safety supervision of special equipment, and urge all relevant departments to perform their supervision and management duties according to law. Establish a safety coordination mechanism for special equipment to coordinate and solve problems in safety supervision and management of special equipment in a timely manner.

Township (town) people's governments, neighborhood offices and development zone management agencies shall assist the relevant departments of the people's governments at higher levels to perform their duties of safety supervision and management of special equipment according to law, and incorporate the safety of special equipment into the daily supervision and inspection scope of safety production. Fifth city, county (Autonomous County) people's government special equipment safety supervision and management department is responsible for the safety supervision and management of special equipment within their respective administrative areas.

Development and reform, education, economic information, public security, planning resources, ecological environment, housing and urban construction, urban management, transportation, cultural tourism, health and emergency management and other relevant departments shall, according to their respective responsibilities, do a good job in the safety supervision and management of special equipment. Article 6 Special equipment industry associations shall strengthen industry self-discipline, promote the construction of industry credit system, provide training, publicity, communication, consultation and other services, guide the production, operation and use units of special equipment to strengthen safety management, and improve the safety management level of special equipment. Seventh special equipment safety supervision and management departments, special equipment industry associations and special equipment production, operation and use units should strengthen the popularization and publicity and education of special equipment safety knowledge, and enhance the public's awareness of special equipment safety. Article 8 Units that produce, operate and use special equipment and inspection and testing institutions are encouraged to adopt advanced technologies such as Internet of Things, big data and cloud computing and recommended national standards, so as to improve the safety performance and risk management level of special equipment, promote energy conservation and consumption reduction of special equipment, and enhance the ability of accident prevention and emergency rescue.

Encourage the production, operation and use of special equipment units and inspection and testing institutions to purchase special equipment safety liability insurance, and improve emergency response and compensation capabilities. Chapter II General Safety Provisions Article 9 Units that produce, operate and use special equipment shall be responsible for the safety of the special equipment they produce, operate and use, assume the main responsibility for safety, and establish, improve and strictly implement the responsibility system for safety, energy saving and environmental protection of special equipment.

The main person in charge of the production, operation and use of special equipment is the first person responsible for the safety, energy saving and environmental protection of special equipment, and is responsible for the safety, energy saving and environmental protection of special equipment produced, operated and used by the unit. Tenth special equipment production units shall comply with the following provisions:

(a) to obtain a production license for special equipment in accordance with the law, and to maintain the conditions required for obtaining a production license;

(two) to ensure that the production of special equipment meets the requirements of safety technical specifications and related standards, and to be responsible for the safety performance of the special equipment produced by it;

(3) When special equipment leaves the factory, it shall be accompanied by design documents, product quality certificates, installation and maintenance instructions, supervision and inspection certificates and other relevant technical data and documents (hereinafter referred to as factory data) required by safety technical specifications, and product nameplates, safety warning signs and their descriptions shall be set in a prominent position of special equipment;

(4) If the legal representative or principal responsible person is changed, it shall be reported to the original production license issuing authority for the record within 30 days from the date of change;

(five) where the name or address of the unit is changed, it shall apply within thirty days from the date of change and go through the formalities for change according to law;

(six) shall not produce special equipment that does not meet the safety performance requirements and energy efficiency indicators, as well as the state explicitly eliminated;

(seven) shall not engage in production activities beyond the scope and duration of the production license;

(eight) shall not forge, alter, resell, lease or lend the production license;

(9) Other provisions of laws and regulations. Eleventh special equipment installation, renovation and maintenance of the construction unit shall, before the construction, the proposed special equipment installation, renovation and maintenance in writing or through the special equipment safety supervision information platform to inform the municipal special equipment safety supervision and management department.

The municipal special equipment safety supervision and management department may entrust the special equipment safety supervision and management department of the county (autonomous county) where the special equipment construction is located to accept the notification.
