1. According to the current regulations, the employer does not have to pay wages during the personal leave;
2. Sick leave with pay, with specific provisions. According to the circularNo. [20 14] 15 issued by the Labor Department of the Ministry of Labor, "Answers to Questions about Labor Contracts in the Implementation of Labor Law" stipulates:
Salary payment standard for employees during sick leave: if the continuous medical treatment period is less than 6 months and the length of service of the enterprise is less than 2 years, it is 60% of the employee's salary; 70% of the salary for two years but less than four years; Over 4 years but less than 6 years, 80% of the salary; Over 6 years but less than 8 years, 90% of the salary; For those who have completed 8 years or more, it is 100% of my salary.
When the continuous medical treatment period exceeds 6 months, according to Article 13 (2) of the Labor Insurance Regulations, the sick pay shall be stopped and paid to the labor insurance fund on a monthly basis. The standards are as follows: 40% of my salary is paid to those who are dissatisfied with their work in this enterprise 1 year; 50% of my salary if it reaches 1 year but less than 3 years; For three years or more, it is 60% of my salary. During the treatment of employees' illness or non-work-related injuries, during the prescribed medical treatment period, the enterprise shall pay their sick pay or disease relief funds in accordance with relevant regulations, which may be paid below the local minimum wage, but not less than 80% of the minimum wage;
3. According to the provisions of the Marriage Law and the Family Planning Regulations, first-time citizens who meet the legal age for marriage can enjoy three days of legal marriage leave; If you get married late for the first time, you can enjoy 15 days of late marriage leave (including 3 days of legal marriage leave); The second married person can only enjoy the legal marriage leave for 3 days, but can't enjoy the late marriage leave. Wages are paid as usual during the marriage leave, which belongs to paid leave;
4. During the funeral leave, the salary will be paid as usual. According to the provisions of the former State General Administration of Labor and the Ministry of Finance on the issue of taking leave for marriage, funeral and travel for employees of state-owned enterprises, when the immediate family members of employees of state-owned enterprises die, enterprises should give employees 1-3 days' funeral leave as appropriate according to the specific circumstances;
Article 51 of the Labor Law of People's Republic of China (PRC) stipulates that "the employer shall pay wages according to law during legal holidays, weddings, funerals and social activities according to law."
Article 11 of the Interim Provisions on Wage Payment of the Ministry of Labor stipulates that "during the period when workers enjoy annual leave, family leave, marriage leave and funeral leave according to law, the employer shall pay the wages of workers according to the standards agreed in the labor contract."
Maternity leave is also paid leave, but the salary is specified.
Article 8 of the Special Provisions on Labor Protection for Female Employees: The maternity allowance for female employees during maternity leave shall be paid by the maternity insurance fund according to the average monthly salary of employees in the previous year; Did not participate in maternity insurance, paid by the employer in accordance with the wage standard of female employees before maternity leave;
6. Annual leave is paid leave, and the salary is paid as usual.
