Measures for the implementation of the Regulations on the Administration of Poultry Slaughtering
Article 1 In order to strengthen the management of livestock and poultry slaughter, prevent the spread of epidemic diseases, ensure the quality and safety of livestock and poultry products, and safeguard human health, these Regulations are formulated in accordance with relevant laws and administrative regulations and in light of the actual situation of this province.
Article 2 These Regulations shall apply to the slaughter of livestock and poultry, the division, refrigeration and transportation related to the slaughter of livestock and poultry, and the supervision and management of the above activities within the administrative area of this province.
Article 3 Livestock and poultry mentioned in these Regulations refer to pigs, cattle, sheep, chickens, ducks and geese raised artificially.
The term "livestock and poultry products" as mentioned in these Regulations refers to the unprocessed carcasses, meat, fat, viscera, blood, bones, heads, hooves and skins of livestock and poultry after slaughter.
Article 4 The province implements a system of fixed-point slaughtering and centralized quarantine of livestock and poultry.
Without a fixed point, no unit or individual may engage in livestock and poultry slaughtering activities. However, rural residents slaughter their own livestock and poultry, except urban residents slaughter their own domestic poultry.
Article 5 The people's governments at or above the county level shall strengthen the leadership over the supervision and management of livestock and poultry slaughter, strengthen the construction of the supervision and management team of livestock and poultry slaughter, increase investment in infrastructure and equipment, and coordinate and solve major problems in the supervision and management of livestock and poultry slaughter in a timely manner. Guide and support the development of livestock and poultry slaughter plants (fields) in the direction of mechanization, scale and standardization.
The people's governments at or above the county level shall incorporate the funds required for the supervision and management of livestock and poultry slaughter into the fiscal budget at the same level.
Article 6 The competent commercial departments of the people's governments at or above the county level shall be responsible for the supervision and management of livestock and poultry slaughter within their respective administrative areas. Its subordinate livestock and poultry slaughter management institutions shall assist the competent commercial authorities in daily supervision and inspection of livestock and poultry slaughter activities within their respective administrative areas, and be entrusted by the competent commercial authorities to impose administrative penalties on acts in violation of these regulations.
The Provincial Land Reclamation Bureau and the Provincial Forest Industry Bureau are responsible for the supervision and management of livestock and poultry slaughter activities in reclamation areas and state-owned forest industry areas, and accept the guidance and supervision of the administrative department of commerce of the provincial people's government in business.
Relevant departments of the people's governments at or above the county level such as animal husbandry and veterinary medicine, health, industry and commerce, quality and technical supervision, environmental protection, ethnic affairs, public security, finance, planning, housing and construction. , should be within the scope of their respective duties, do a good job in the supervision and management of livestock and poultry slaughter according to law.
The Township People's Government shall assist the administrative department of commerce of the people's government at the county level to do a good job in the supervision and management of livestock and poultry slaughter activities in this township.
Seventh producers and operators shall be responsible for the quality and safety of livestock and poultry products they produce, process and sell, and shall not produce, process or sell livestock and poultry products that do not meet the statutory requirements.
Eighth encourage livestock and poultry slaughtering enterprises and livestock and poultry products operators to set up professional trade organizations according to law on a voluntary basis, and play a role of coordination and self-discipline.
Chapter II Establishment, Alteration and Cancellation of Slaughterhouse (Field)
Article 9 The planning of livestock and poultry slaughtering plant (field) shall be formulated by the competent commercial department of the provincial people's government jointly with relevant departments in accordance with the principles of rational layout, moderate concentration, favorable circulation and convenience for the masses, combined with the actual situation of this province, and implemented after being approved by the provincial people's government.
The planning of livestock and poultry slaughter plants (fields) shall include the number and layout of livestock and poultry slaughter plants (fields) and small pig slaughterhouses.
The establishment of livestock and poultry slaughtering plants (fields) and small pig slaughterhouses (including new construction and relocation, the same below) shall conform to the planning of livestock and poultry slaughtering plants (fields).
Tenth livestock and poultry slaughtering plant (field), small pig slaughterhouse site selection, should comply with the provisions of planning, construction, land, environmental protection, animal epidemic prevention, food safety and other relevant laws and regulations.
Eleventh the establishment of livestock and poultry slaughtering plant (field) shall meet the following conditions:
(a) there are water sources suitable for the scale of slaughter, and the water quality meets the standards set by the state;
(2) Having waiting rooms, slaughter rooms, emergency slaughter rooms, livestock and poultry slaughter equipment and vehicles that meet the requirements of the state;
(three) there are slaughter technicians who are suitable for the slaughter scale and have obtained health certificates according to law;
(four) there are meat quality inspectors who are suitable for the slaughter scale and have passed the examination by the administrative department of commerce of the provincial people's government;
(5) Having inspection equipment, disinfection facilities, disinfection drugs and pollution prevention facilities that meet the national requirements;
(6) Harmless treatment facilities for diseased livestock and poultry and livestock and poultry products;
(seven) to obtain the certificate of animal epidemic prevention conditions according to law;
(eight) other conditions stipulated by laws and regulations.
Article 12 To apply for the establishment of a designated livestock and poultry slaughtering plant (field), a written application shall be submitted to the competent commercial department of the local city (prefecture) people's government (administrative office). The administrative department of commerce of the people's government (administrative office) of the city (prefecture) shall, within 20 working days from the date of receiving the application, conduct a review in conjunction with relevant departments according to the planning of the livestock and poultry slaughtering plant (field).
The competent department of commerce of the people's government of the city (prefecture) shall, after soliciting the opinions of the competent department of commerce of the people's government of the province in writing, report to the people's government of the city (prefecture) for a written decision on whether to agree or disagree with the construction of designated slaughtering plants (fields) for livestock and poultry. The competent commercial department of the provincial people's government shall make a reply within seven working days.
The applicant can build a designated livestock and poultry slaughtering plant (field) after obtaining the written decision of the Municipal People's Government (administrative office) to agree to the construction.
