Article 1 In order to do a good job in the resettlement of retired soldiers and ensure their first employment in accordance with the law, these rules are formulated in accordance with the Military Service Law of People's Republic of China (PRC), the Regulations on the Resettlement of Retired Conscripts, the Regulations on the Administration of Resettlement of Retired Soldiers in Yunnan Province and other laws and regulations, combined with the actual situation of our city. ?
Article 2 The term "ex-soldiers" as mentioned in these Detailed Rules refers to the local ex-servicemen recruited by the People's Armed Forces Department of the county (city) under the jurisdiction of Kunming; Demobilized noncommissioned officers who meet the resettlement conditions shall be resettled within their respective jurisdictions. ?
Article 3 The Resettlement Office of Kunming Municipal People's Government shall be responsible for the reception and resettlement of retired soldiers in the whole city. The resettlement office of the county (city) District People's Government shall be responsible for the reception and resettlement of retired soldiers within its jurisdiction. The competent authority of the above-mentioned institutions is the civil affairs department. ?
Planning, personnel, labor, organization, finance, public security, food, people's armed forces and other departments shall, according to their respective responsibilities, do a good job in the reception and resettlement of retired soldiers. ?
Fourth soldiers discharged from active service, by the original collection of the county (city) District People's government veterans resettlement office is responsible for receiving. Receiving time, according to the provisions of the State Council, the Central Military Commission (CMC) and the provincial people's government. ?
When retired soldiers return to the original collection place, the local people's government shall organize the reception and be responsible for the training and management education during the period to be assigned. ?
Fifth city, county (city) financial department shall, according to the requirements of the number of retired soldiers received in the administrative area and the financial management system, allocate resettlement funds according to the standard of not less than 200 yuan per capita. ?
Sixth veterans resettlement office according to the total number of retired soldiers in that year, timely formulate resettlement plans and resettlement indicators, submitted to the people's government at the next higher level for approval before implementation. ?
Resettlement index is the mandatory plan index of the government, once issued, it shall not be changed without the approval of the government. Resettlement indicators are issued according to the proportion determined by the total number of employees of each unit and the provincial people's government in that year. Units with less than 100 people shall be calculated as 100 people. ?
Seventh central units in Kunming resettlement plan, issued by the provincial people's government and then decomposed by the municipal government issued; Provincial and municipal units of the resettlement plan, issued by the Municipal People's government, counties (cities) will not repeat; The resettlement plan of non-public economic units shall be issued by the local people's government. ?
Eighth organs, organizations, enterprises and institutions within the administrative area of this Municipality, regardless of the nature of ownership and organizational form, have the obligation to receive and resettle retired soldiers according to regulations. ?
All units must complete the annual receiving and resettlement task on time according to the resettlement indicators. Units with superior personnel management rights shall not refuse to accept retired soldiers. When the competent department issued the increase index in that year, it should reserve the resettlement index of retired soldiers according to the proportion of the total number of employees; At the end of the year, the competent department issued the index of increasing the number of people, and should first complete the resettlement task of retired soldiers, and then declare the index to the higher authorities. The competent department shall not prevent subordinate units from receiving and resettling retired soldiers. When newly-built and expanded units increase personnel, they should complete the resettlement task of retired soldiers before recruiting and transporting personnel to the society. ?
Article 9 The government advocates and encourages retired soldiers to find their own jobs. Specific measures are as follows:
(a) in line with the distribution conditions of self-employed retired soldiers engaged in self-employed and new private enterprises, by the local resettlement department issued a self-employed certificate, the industrial and commercial departments give priority to the business license, and exempt from industrial and commercial management fees for two years; With the approval of the local tax authorities at the county level, it will be exempted from income tax for two years from the date of opening. ?
(2) Retired soldiers who meet the working conditions for distribution shall be given a one-time economic compensation by the government after their own application and approval by the resettlement department and self-employment procedures. The specific criteria are: retired soldiers have served in active service for two years, and the compensation base is 1.5 million yuan. Overtime will be increased by 2,000 yuan for each full year, with a maximum compensation of 40,000 yuan. Its files are kept by local talent service agencies or labor employment agencies. ?
(3) Where ex-soldiers in rural areas are engaged in agricultural production, the relevant departments shall give priority and help in production services, technical guidance, supply of agricultural materials and acquisition of agricultural and sideline products. ; For those with expertise, the local government should provide the necessary conditions.
Help them set up new private enterprises and develop the tertiary industry, planting and aquaculture. ?
Tenth county (city) district talent, labor market (or talent service agencies) should give priority to providing services for the employment and resettlement of retired soldiers. For the employing units that receive and resettle retired soldiers, the fees shall be reduced or exempted; For retired soldiers, free entry, free registration and priority recommendation for employment are provided with relevant documents. ?
Any county (city) district with more than 30 people can organize a special meeting of supply and demand according to its own reality and choose to resettle retired soldiers. ?
Eleventh where there is no good person in the talent labor market or the unit that has not completed the resettlement plan index, the veterans resettlement department shall regularly allocate retired soldiers to the employer as planned. ?
Twelfth retired soldiers file materials should be complete, and in line with the provisions or approved by the Yunnan Provincial Department of resettlement of retired soldiers, should be accepted. The files of retired soldiers are incomplete, and there is no "Registration Form for the Placement of Urban Non-agricultural Population Recruited Youth", and the veterans resettlement department will not accept it. ?
For urban retired soldiers who occupy the rural recruitment index and join the army in the non-hukou location, the people's government where the original hukou is located only allows them to go through the formalities of settling down and leaving grain, and will not be resettled. For rural retired soldiers who violate the regulations during their service or after retirement, no work will be arranged. ?
Due to the needs of national construction, if parents change from rural areas to non-rural areas in accordance with state regulations during their service, they can be resettled in their parents' places after approval by the people's government at a higher level. ?
Thirteenth where in the city and the county (city) area under the jurisdiction of the retired soldiers, with a letter of introduction issued by the local government resettlement department to the public security and food departments to give priority to settle down, food procedures. ?
Fourteenth due to special difficulties can not meet the resettlement targets of the unit, submit a written application, approved by the people's government issued the plan, can implement the resettlement task paid transfer. Units that implement paid transfer and resettlement tasks receive 1 person every year, and pay 50,000 yuan transfer and resettlement fees according to the resettlement indicators issued in that year. Transfer and resettlement funds shall be collected by the immigration department of the government at the same level that issued the plan, and shall be included in the financial special account management in accordance with the relevant provisions of extra-budgetary funds, and shall be used for special purposes. If the transfer and resettlement funds are insufficient, the financial arrangements at the same level will be subsidized. ?
Fifteenth units to pay the transfer and resettlement funds shall be paid in full within the prescribed time limit with the "Notice on the Collection of Transfer and Resettlement Funds for Retired Soldiers" and the entrusted receipt certificate issued by the local government's veterans resettlement department. Those who fail to pay within the time limit shall pay the overdue fine according to the standard of 5‰ every day. ?
Article 16 The scope of use of transfer and resettlement funds is as follows:
(a) reward units that have overfulfilled the receiving and resettlement tasks; ?
(two) to pay a one-time economic compensation to retired soldiers who meet the working conditions and apply for self-employment; ?
(three) to pay the training fee and special hardship living allowance for retired soldiers. ?
Seventeenth receiving units shall sign labor contracts with the retired soldiers they receive according to law. If a retired soldier has worked in the receiving unit for less than 3 years during the contract period or for reasons other than his own, the unit shall not terminate the labor contract or arbitrarily arrange to be laid off. ?
Eighteenth units must unconditionally accept the disabled retired soldiers assigned by the local government. Anyone who receives and resettles second-and third-class disabled retired soldiers will receive 1 person, and 2 normal retired soldiers will be received as planned. Units that refuse to accept disabled soldiers will double the transfer and resettlement funds according to the number of planned indicators issued. ?
The receiving unit shall arrange work within its capacity for the disabled retired soldiers it receives, and their wages, insurance, welfare and other benefits shall be implemented in accordance with the relevant state regulations on work-related disability and illness. Disabled retired soldiers who have been identified as 5- 10 by labor shall not terminate their labor contracts at will, and shall not be laid off for reasons other than their own. ?
The people's governments at all levels shall, in accordance with the relevant provisions of the state and the province, guarantee the funds needed for the housing construction of retired soldiers with special and first-class disabilities.
Article 19 In order to ensure the normal life of retired soldiers, the local people's government will pay monthly living allowance to retired soldiers who meet the resettlement conditions from the month when they report for duty. If the normal resettlement period is exceeded due to non-personal reasons, the specific payment time will be from April1; Demobilized noncommissioned officers will be hired from August 1. Those who have been approved to retain their qualifications for two years' extension shall take care of their living expenses from the month of approval. Do not obey the distribution, never obey the distribution of the month to stop living allowance. ?
Twentieth retired soldiers who meet the resettlement conditions shall not be arranged for work under any of the following circumstances:
(a) resort to deceit, cheat hero honor or forge a disability certificate; ?
(2) Being subject to criminal punishment during the period to be allocated; ?
(three) without justifiable reasons, not according to the prescribed time to report to the resettlement department; ?
(four) do not obey the distribution or do not report to the receiving unit within ten days after receiving the letter of introduction; ?
(5) Addicted to taking or injecting drugs. ?
For the above-mentioned retired soldiers who do not arrange work, their files shall be kept by the local labor and employment agencies or talent service centers, and I shall go through the formalities of settling down and falling grain with the letter of introduction issued by the local resettlement department. ?
Twenty-first units that have made remarkable achievements in the resettlement of retired soldiers shall be commended and rewarded by the people's government. Units that receive retired soldiers beyond the plan will be rewarded with 1 10,000 yuan for each person they receive. ?
Article 22 Whoever, in violation of the detailed rules for the implementation, refuses or delays receiving retired soldiers within the time limit stipulated in the distribution notice issued by the resettlement department shall be given informed criticism and punished according to the standards stipulated in the Regulations on the Administration of Resettlement of Retired Soldiers in Yunnan Province, Decree No.88 of the provincial government. The fine shall be paid into the state treasury at the corresponding level. ?
Twenty-third units that refuse to accept and fail to complete the plan, in addition to the implementation of Article 22, the people's governments at all levels should also hold the leaders of the units accountable; The unit shall not be rated as "double support" advanced unit and "spiritual civilization" unit; The personnel and labor department stopped the personnel transfer and transfer approval of the unit in the current year; Personnel rights are not in the city and counties (cities) district units, before the completion of the resettlement plan indicators, transferred to the personnel, public security, food departments shall not handle the procedures for settling down and falling grain. ?
Twenty-fourth retired soldiers, in violation of these rules, do not obey the distribution and do not report to the receiving unit according to the prescribed time, their distribution qualification will be cancelled and treated as unemployed. ?
Twenty-fifth of these rules shall be interpreted by the Kunming Municipal People's government veterans resettlement office.
