Chapter I General Provisions

Article 1 In order to ensure the Standing Committee of Wenzhou Municipal People's Congress (hereinafter referred to as Wenzhou Municipal People's Congress Standing Committee) to exercise the power of appointment and removal of personnel according to law, according to the Supervision Law of the Standing Committee of the People's Congress of the People's Republic of China, the Organic Law of the People's Congress of the People's Republic of China and Local People's Governments at Various Levels, the Organic Law of the People's Congress of the People's Republic of China and the Organic Law of the People's Congress of the People's Republic of China.

Article 2 The Standing Committee of the Municipal People's Congress shall fully implement the policy of revolutionization, youthfulness, knowledge and specialization, adhere to the principle of having both ability and political integrity, fully promote democracy and act in strict accordance with the law.

Article 3 The Standing Committee of the Municipal People's Congress shall exercise the following personnel appointment and removal rights according to law:

(1) To decide on the appointment and removal. To decide on the appointment and removal of individual deputy mayors of the Municipal People's Government when the Municipal People's Congress is not in session; To decide on the appointment and removal of the Secretary-General, the director and the director of the Committee who are members of the Municipal People's Government, and report to the provincial people's government for the record.

(2) appointment and removal. To appoint or remove the chairman, vice-chairmen and members of the credentials committee of the Standing Committee of the Municipal People's Congress, and the candidates for the credentials committee must be nominated from among the members of the Standing Committee of the Municipal People's Congress; To appoint and remove the deputy secretary-general, director of the office, deputy director, director and deputy director of the research office, and director and deputy director of the working committees of the Standing Committee of the Municipal People's Congress; When the Municipal People's Congress is not in session, the appointment and removal of individual vice-chairmen and some members of the special committees of the Municipal People's Congress, and the candidates for members of the special committees of the Municipal People's Congress must be nominated among the deputies to the Municipal People's Congress; To appoint and remove the vice presidents, members of judicial committees, presidents, vice presidents and judges of the Municipal Intermediate People's Court; To appoint and remove the Deputy Procurator-General, members of the Procuratorial Committee and procurators of the Municipal People's Procuratorate.

(3) To approve the appointment, removal and resignation. To approve the appointment and removal of the chief procurator of the county (city, district) people's procuratorate and the resignation of the chief procurator of the county (city, district) people's procuratorate.

(4) to select and decide on the candidates for agency. When the Municipal People's Congress is not in session, when the director of the Standing Committee of the Municipal People's Congress is unable to work or absent for some reason, the Standing Committee of the Municipal People's Congress shall elect one of its deputy directors to act as the director. When the main leaders of the Municipal People's Government, the Municipal Intermediate People's Court and the Municipal People's Procuratorate are unable to hold their posts for some reason, they shall decide the candidates for the agency from their deputy leaders.

Decided to act as attorney general, shall be submitted to the provincial people's Procuratorate and the provincial people's Congress Standing Committee for the record.

(5) Revocation of duties. When the Municipal People's Congress is not in session, it is decided to revoke the post of deputy mayor of individual municipal people's governments; Decided to revoke the positions of the Secretary-General, the Secretary-General and the Chairman of the Committee as members of the Municipal People's Government; Decided to revoke the positions of vice president, members of the judicial committee, president, vice president and judge of the Municipal Intermediate People's Court; Decided to revoke the post of Deputy Procurator-General, member of the procuratorial committee and procurator of the Municipal People's Procuratorate.

(6) Accepting resignation. Accepting the resignation of the members of the Standing Committee of the Municipal People's Congress and the members of the special committees of the Municipal People's Congress when the Municipal People's Congress is not in session; Accept the resignation of the mayor and deputy mayor of the Municipal People's Government, the president of the Municipal Intermediate People's Court and the procurator-general of the Municipal People's Procuratorate. The resignation of the above-mentioned personnel shall be reported to the Standing Committee of the Municipal People's Congress for the record. The resignation of the chief procurator of the Municipal People's Procuratorate shall be submitted to the Provincial People's Procuratorate for approval by the Standing Committee of the Provincial People's Congress.

Article 4 Procedures for the Standing Committee of the Municipal People's Congress to exercise the power of appointment and removal of personnel: proposing the case of appointment and removal of personnel, discussing it at the meeting of directors, deliberating it at the meeting of the Standing Committee, voting on it, publishing it, and issuing a letter of appointment.

Chapter II Submission of Personnel Appointment and Removal

Article 5 The case of appointment and dismissal of personnel submitted to the Standing Committee of the Municipal People's Congress for deliberation shall be signed by the chief leader of the submitting organ, and shall generally be submitted 7 days before the meeting of the Standing Committee of the Municipal People's Congress. Before the appointment of the Standing Committee of the Municipal People's Congress, the personnel to be appointed shall generally be submitted 15 days before the meeting of the Standing Committee of the Municipal People's Congress, and the office of the relevant Committee of the Standing Committee of the Municipal People's Congress shall promptly notify the members of the Standing Committee of the Municipal People's Congress.

Article 6 Personnel appointment and dismissal cases shall be submitted according to the following categories:

(a) the election and decision of the director of the Standing Committee of the Municipal People's Congress, the mayor of the Municipal People's Government, the president of the Municipal Intermediate People's Court and the chief procurator of the Municipal People's Procuratorate shall be submitted by the meeting of directors of the Standing Committee of the Municipal People's Congress.

(II) The appointment and removal of Deputy Secretary-General, Director of Office, Deputy Director, Director of Research Office, Deputy Director, Director of Working Committee and members of the Standing Committee of the Municipal People's Congress, and the appointment and removal of individual deputy directors and some members of the special committees of the Municipal People's Congress shall be submitted by the meeting of directors of the Standing Committee of the Municipal People's Congress.

(3) The appointment and removal of the deputy mayor, secretary general, director and director of the Committee of the Municipal People's Government shall be submitted by the mayor of the Municipal People's Government.

(four) the appointment and removal of the vice president, members of the judicial committee, the president, the vice president and judges of the Municipal Intermediate People's Court shall be submitted by the president of the Municipal Intermediate People's Court.

(5) The appointment and removal of deputy procurators, members of procuratorial committees and procurators of the Municipal People's Procuratorate, and the approval of the appointment, removal and resignation of the chief procurator of the county (city, district) People's Procuratorate shall be submitted by the chief procurator of the Municipal People's Procuratorate.

Article 7 When submitting the case of personnel appointment and dismissal, it is necessary to provide basic information, main resume, inspection materials and other materials that should be explained.

The relevant materials submitted to the authorities shall reflect the ideological and political quality, professional ability, legal knowledge and legal concept of the personnel to be employed.

The Standing Committee of the Municipal People's Congress shall organize the pre-service legal knowledge examination for the personnel to be appointed. The results of the review shall be reported to the meeting of directors of the Standing Committee of the Municipal People's Congress, and the organ to be appointed shall be notified. Without the approval of the Standing Committee of the Municipal People's Congress, those who fail to take the exam or fail to pass the exam without reason shall not be submitted to the meeting for appointment.

Article 8 If a member of the Standing Committee of the Municipal People's Congress, a member of a special committee of the Municipal People's Congress, the mayor and deputy mayor of the Municipal People's Government, the president of the Municipal Intermediate People's Court and the procurator-general of the Municipal People's Procuratorate resign, I shall submit a resignation report to the Standing Committee of the Municipal People's Congress.

Article 9 The meeting of directors of the Standing Committee of the Municipal People's Congress may put forward suggestions to the Standing Committee of the Municipal People's Congress on the dismissal of the staff of state organs listed in Item (5) of Article 3 of these Measures.

More than one-fifth of the members of the Standing Committee of the Municipal People's Congress may jointly submit a written proposal to the Standing Committee of the Municipal People's Congress to recall the staff of state organs listed in Item 5 of Article 3 of these Measures, and the meeting of directors shall decide whether to submit it to the meeting of the Standing Committee of the Municipal People's Congress for deliberation; It can also be proposed by the meeting of directors, decided by the plenary meeting to organize an investigation Committee, and decided by the follow-up meeting of the Standing Committee of the Municipal People's Congress according to the report of the investigation Committee.

Dismissal cases shall specify the object and reason of dismissal, and provide relevant materials.

Before the recall case is put to the vote, the person who is proposed to be recalled has the right to make representations at the meeting of the Standing Committee of the Municipal People's Congress, or make representations in writing, and the meeting of directors will decide to print and distribute them to the meeting of the Standing Committee of the Municipal People's Congress.

Chapter III Discussion and Deliberation

Tenth submitted to the Municipal People's Congress Standing Committee for consideration of the appointment and removal of personnel, the meeting of directors shall first listen to the introduction of the relevant departments to the proposed appointment and removal of personnel. If the situation is unknown and the materials are not uniform, the submitting organ shall be responsible for ascertaining the situation and supplementing or resubmitting the materials.

Eleventh meeting of directors of the Standing Committee of the Municipal People's Congress decided through discussion whether to submit the case of personnel appointment and removal to the meeting of the Standing Committee of the Municipal People's Congress for deliberation.

Twelfth personnel appointment and removal case shall be read out and explained by the person in charge of the submitting organ. When the meeting of the Standing Committee of the Municipal People's Congress deliberates, the submitting organ shall send someone to answer questions and explain the situation. When necessary, the proposed personnel shall meet with the members of the Standing Committee of the Municipal People's Congress.

Article 13 After the personnel appointment and removal case is put forward, before the meeting of the Standing Committee of the Municipal People's Congress is held, if there are major problems in the personnel to be appointed and removed, the submitting organ shall submit an investigation and verification report to the meeting of directors or the Standing Committee of the Municipal People's Congress.

When the Standing Committee of the Municipal People's Congress finds that the personnel to be appointed or removed have important problems that can affect the appointment or removal, it shall submit a written report to the organ for investigation and verification as soon as possible. If it is difficult to find out during the meeting, it may not be put to the vote temporarily upon the proposal of the director meeting and the consent of the Standing Committee of the Municipal People's Congress. After the problem is identified, the submitting organ shall submit a written report, and the meeting of directors shall decide whether to submit it to the next meeting of the Standing Committee of the Municipal People's Congress for deliberation.

Included in the agenda of the meeting of the Standing Committee of the Municipal People's Congress, the appointment and removal of personnel case, before the vote, submitted to the authorities for a written request to withdraw, the deliberation of the appointment and removal case shall be terminated.

Chapter IV Voting

Fourteenth consideration of the appointment and dismissal of personnel shall be submitted to the plenary meeting of the Standing Committee of the Municipal People's Congress for voting.

Fifteenth Municipal People's Congress Standing Committee meeting to vote on the appointment and removal of personnel, by secret ballot.

Personnel appointment and removal cases shall be voted item by item, and may be voted together according to the circumstances.

Sixteenth Municipal People's Congress Standing Committee meeting to vote on the appointment and removal of personnel, by more than half of all members of the Municipal People's Congress Standing Committee.

The voting result was announced on the spot by the meeting host.

Seventeenth candidates who have been submitted to the Standing Committee of the Municipal People's Congress for appointment but have not been approved may be submitted for appointment again, but they may not be repeated at this meeting of the Standing Committee. Candidates who fail to pass two votes may not be invited to hold the same post during the current term of office of the NPC Standing Committee.

Chapter V Publication and Supervision

Article 18 The case of appointment and removal of personnel passed by the Standing Committee of the Municipal People's Congress shall be published by the Standing Committee of the Municipal People's Congress and published in the Bulletin of the Standing Committee of Wenzhou Municipal People's Congress, the portal of Wenzhou People's Congress and Wenzhou Daily.

Nineteenth municipal people's Congress Standing Committee appointed by the staff of state organs, the Municipal People's Congress Standing Committee issued a letter of appointment, you can also entrust the agency to issue a letter of appointment.

The letter of appointment was signed by the director of the Standing Committee of the Municipal People's Congress.

Twentieth staff of state organs appointed by the Standing Committee of the Municipal People's Congress shall not go to work before the meeting of the Standing Committee of the Municipal People's Congress for deliberation and approval, and shall not be announced to the public.

Twenty-first after the general election of the Municipal People's Congress, the mayor of the Municipal People's Government shall, within two months, draw the Standing Committee of the Municipal People's Congress to appoint members of the new Municipal People's Government.

The Standing Committee of the Municipal People's Congress re-appointed its deputy secretary-general, director of the office, deputy director, director of the research office, deputy director and members of the working committees. If the above-mentioned personnel have not been re-employed, their original positions will be naturally exempted, and legal dismissal procedures will no longer be handled.

The personnel of the Municipal Intermediate People's Court and the Municipal People's Procuratorate appointed by the Standing Committee of the Municipal People's Congress shall not be re-elected if their positions have not changed.

The staff of state organs appointed by the Standing Committee of the Municipal People's Congress need to be re-appointed due to the change of the name of the working institution; If the working organization is revoked, the dismissal procedures shall be handled.

If a functionary of a state organ appointed by the Standing Committee of the Municipal People's Congress leaves his post or retires, he shall be relieved of his post.

The Standing Committee of the Twenty-second Municipal People's Congress may, by listening to and deliberating special work reports, inspecting law enforcement, putting forward inquiries and inquiry cases, organizing the investigation, deliberation and decision of recall cases on specific issues, etc. To conduct legal supervision and work supervision over the work of staff appointed by state organs.

The Standing Committee of the Twenty-third Municipal People's Congress accepts the reports, exposures and complaints of citizens and units against the staff of state organs, and handles them according to law.

Twenty-fourth national staff appointed by the Standing Committee of the Municipal People's Congress are subject to criminal investigation or administrative sanctions, and the case-handling organ shall report to the Standing Committee of the Municipal People's Congress in a timely manner.

Chapter VI Rules

Twenty-fifth to attend the provincial people's Congress on behalf of the city by-election, resignation and recall, in accordance with the relevant provisions of the Representative Law and the Electoral Law.

Twenty-sixth Municipal People's Congress Standing Committee on behalf of the working committee is responsible for the specific affairs related to the appointment and removal of personnel.

Twenty-seventh these Measures shall be implemented after the meeting of the Standing Committee of the Municipal People's Congress.
