Regulations of Baotou Municipality on Urban Greening (revised in 2020)

Chapter I General Provisions Article 1 In order to strengthen the construction and management of urban green space, protect green space, improve urban landscape environment and promote the construction of livable cities, these Regulations are formulated in accordance with the Regulations of the State Council Municipality on Urban Greening and relevant laws and regulations, combined with the actual situation of this Municipality. Article 2 These Regulations shall apply to the planning, construction, protection, supervision and management of urban green spaces such as parks, attached green spaces, residential green spaces, protective green spaces, production green spaces, road green spaces and other green spaces within the urban planning area of this Municipality.

If the superior law has already made provisions, its provisions shall prevail. Article 3 Urban greening shall adhere to the principles of government leading, social participation, scientific planning, giving priority to protection, adapting measures to local conditions and stressing practical results. Article 4 The municipal and district people's governments shall incorporate urban greening into the national economic and social development plan, and include urban greening funds into the fiscal budget at the same level. Article 5 The municipal and district people's governments shall scientifically organize urban greening, improve urban greening coverage and green space standards, strictly manage urban green space, and put an end to encroachment on urban green space. Article 6 The competent department of housing and urban-rural construction of the Municipal People's Government shall be responsible for the urban greening work of this Municipality, and may entrust the municipal landscaping management institution to implement the specific greening work.

The people's governments of Kundulun District, Qingshan District, Donghe District and Jiuyuan District shall be responsible for urban greening within their respective jurisdictions in accordance with the terms of reference determined by the Municipal People's Government.

The Administrative Committee of Rare Earth Hi-tech Industrial Development Zone shall be responsible for urban greening within its jurisdiction in accordance with the provisions of the Municipal People's Government.

The competent department of housing and urban and rural construction of the municipal and district people's governments shall supervise and inspect the greening construction, maintenance and management of each unit and give technical guidance.

Municipal and District People's government development and reform, finance, natural resources, water, transportation, forestry and grassland, urban management comprehensive law enforcement and other departments within the scope of their respective duties, do a good job in urban greening related work. Seventh any unit or individual has the right to stop, complain and report the damage to plants and greening facilities; Have the right to complain and report the administrative inaction and other illegal acts of the competent departments of housing and urban and rural construction, natural resources and urban management comprehensive law enforcement of the municipal and district people's governments in greening management. Chapter II Planning and Construction Article 8 The competent department of housing and urban and rural construction of the Municipal People's Government shall, jointly with the competent department of natural resources at the same level, formulate the urban green space system planning of this Municipality according to the national economic and social development plan, and incorporate it into the overall urban planning of this Municipality after being submitted to the Municipal People's Government for examination and approval.

Before the urban green space system planning is submitted for examination and approval, the preparation department shall publicize the draft plan and solicit the opinions of relevant departments, the public and experts through argumentation meetings, hearings or other forms. Ninth urban green space system planning should be connected with the overall land use planning, forestry planning, water resources planning, environmental protection planning and so on. Tenth preparation of urban green space system planning, should determine the greening objectives and layout, and stipulate the control principles of all kinds of green space; Determine the area of green space according to the prescribed standards, and rationally arrange different levels of green space; According to the requirements of combining universal greening with key greening, a complete urban greening system will be formed. Article 11 The competent department of natural resources of the people's government of a city shall, jointly with the competent department of housing and urban and rural construction at the same level, determine the planning of urban green space construction in the preparation of regulatory detailed planning according to the principles of urban green space system planning and these Regulations, and report it to the Municipal People's government for examination and approval.

Urban green space construction planning should determine the boundaries and specific coordinates of green space. The urban green space determined by the urban green space construction plan shall be announced to the public and subject to supervision. Twelfth city, District People's government housing and urban and rural construction departments in accordance with the urban green space system planning and urban green space construction planning, the preparation of urban green space construction annual plan, and organize the implementation. Thirteenth urban greening construction to implement green rate index control, should be determined in accordance with the following standards:

(a) the green rate of new urban areas shall not be less than thirty-eight percent;

(two) the green rate of the reconstruction area shall not be less than twenty-eight percent;

(3) The total area of production green spaces such as nurseries and flower beds shall not be less than 2% of the total area of urban built-up areas. Fourteenth urban park green space layout should adhere to the principle of overall arrangement of green space area and location and rational layout at different levels.

The area of the new district shall be determined according to the following principles:

(a) within 500 meters in diameter, at least one park green space of 1000 square meters is planned to be built;

(2) At least one park with a diameter of1000m is planned to be built, with an area of more than 5,000m2;

(three) within two thousand meters in diameter, at least one park green space of more than ten thousand square meters should be planned and built.

The reconstruction area shall be implemented with reference to the provisions of the preceding paragraph. Fifteenth types of urban construction projects, should be supporting arrangements for the corresponding green land, construction land area ratio should be:

(1) Road green space: the green space rate of landscape roads is not less than 40%, the green space rate of roads with red line width greater than 50m is not less than 30%, the green space rate of roads with red line width between 40 and 50m is not less than 25%, and the green space rate of roads with red line width less than 40m is not less than 20%;

(2) Green space in residential areas: not less than 30% for newly developed residential areas and not less than 25% for rebuilt residential areas;

(3) Green space attached to the unit: no less than 20% of newly-built primary and secondary schools and commercial centers, no less than 30% of institutions of higher learning, no less than 35% of organs, institutions, military units, hospitals and public cultural places, and no less than 30% of other units. If the area of attached green space of the original unit is lower than the above standard, the proportion of attached green space of the new unit can be reduced by 5%.

(4) Other green space: It shall be implemented according to the Standards of Urban Land Classification and Planning and Construction Land, Code for Park Design, etc.
