Do interns have social security?

Legal analysis: students are students, who use their spare time to work, study and practice. These are not considered as employment and are not subject to the adjustment and protection of the labor law, because interns are not laborers in the sense of the labor law. The relationship between interns and employers is labor relations, not labor relations. Only labor relations can apply for social security. According to the Interim Conditions for the Collection and Payment of Social Insurance Fees, students are not included in the collection scope, so they cannot pay social security.

Legal basis: Article 4 of People's Republic of China (PRC) Social Insurance Law: Employers and individuals in People's Republic of China (PRC) pay social insurance premiums according to law, and have the right to inquire about payment records and personal rights and interests records, and ask social insurance agencies to provide social insurance consultation and other related services.

Individuals enjoy social insurance benefits according to law and have the right to supervise the payment of their own units.
