Legal analysis:

If the social security or personal tax payment certificate for more than 5 years does not require continuous payment, it is allowed to suspend payment halfway for up to three months. Payment is discontinuous. Non-local resident families whose foreign household registration (1) does not have any residence under the family name in Shanghai and who have paid 60 months of social insurance or personal income tax in the 63 months before the online signing date are restricted from buying 1 house; (2) Non-resident families who own 1 set or more houses in this city are suspended from selling their houses in this city; (3) Non-Shanghai registered families who have paid social insurance or personal income tax for 60 months within 63 months before the online signing date will be suspended from selling their houses in this city.

Legal basis:

Article 7 of the Measures for the Administration of Commercial Housing Sales stipulates that the sale of commercial housing shall meet the following conditions: (1) A real estate development enterprise shall have the business license of enterprise legal person and the qualification certificate of real estate development enterprise when selling commercial housing; (2) Obtaining a land use right certificate or a land use approval document; (3) Holding a construction project planning permit and a construction permit; (4) It has passed the completion acceptance; (five) the demolition and resettlement has been implemented; (six) water supply, power supply, heating, gas, communications and other supporting infrastructure have delivery conditions, other supporting infrastructure and public facilities have delivery conditions or have determined the construction progress and delivery date; (seven) the property management plan has been implemented.
