Provisions on social security payment in the month when employees leave their jobs

China's labor law stipulates that the salary of the month of resignation shall be paid by the original company. Article 58 of the Social Insurance Law of People's Republic of China (PRC) also stipulates that the employer shall handle social insurance registration for employees within 30 days from the date of employment. If the social insurance has not been registered, the social insurance agency shall verify the social insurance premium it should pay. When the employee terminates the labor relationship with the employer, the employer shall also pay social security to the employee in the month when the employee leaves his job. Article 63 of the Social Insurance Law: If the employer fails to pay social insurance premiums in full and on time, the social insurance premium collection agency shall order it to pay or make up within a time limit.
