Do I need to pay for my own social security when I receive unemployment benefits?
While receiving unemployment insurance benefits, the unemployed shall participate in the basic medical insurance for employees and enjoy the basic medical insurance benefits.
The basic medical insurance premiums that the unemployed should pay are paid from the unemployment insurance fund, and individuals do not pay the basic medical insurance premiums.
And the standard of the unemployment insurance benefit shall be determined by the people's governments of provinces, autonomous regions and municipalities directly under the central government, and shall not be lower than the standard of the minimum subsistence guarantee for urban residents.
Unemployed persons shall receive unemployment insurance benefits from the Unemployment Insurance Fund if they meet the following conditions:
1. The employer and the person himself have paid unemployment insurance premiums for one year before becoming unemployed;
2. The person who has interrupted his employment not because of his own will;
3. The person who has registered as unemployed and has a requirement to find a job.
Article 46 of the Social Insurance Law of the People's Republic of China
Where the employer and the unemployed person have paid contributions for one year or less than five years prior to his/her unemployment, the maximum period for receiving unemployment insurance benefits shall be twelve months; where the total contributions have been paid for five years or less than ten years, the maximum period for receiving unemployment insurance benefits shall be eighteen months; and where the total contributions have been paid for ten years or more, the maximum period for receiving unemployment insurance benefits shall be twenty-four months. If one is re-employed and becomes unemployed again, the period of contributions is recalculated, and the period of receiving unemployment insurance benefits is combined with the period of receiving unemployment insurance benefits that should have been received but have not yet been received for the previous unemployment, with the maximum period not exceeding twenty-four months.
Article 51 of the Social Insurance Law of the People's Republic of China
An unemployed person shall cease to receive unemployment insurance benefits, and at the same time cease to be entitled to other unemployment insurance benefits, if, during the period of receiving such benefits, he or she is under any of the following circumstances:
(a) re-employed;
(b) conscripted to serve in the armed forces;
(c) emigrated to a place outside the country;
(iv) enjoying basic pension insurance benefits;
(v) refusing, without justifiable reasons, to accept appropriate work introduced or training provided by the designated department or organization of the local people's government.
Article 50 of the Social Insurance Law of the People's Republic of China The employer shall promptly issue a certificate of termination or dissolution of labor relations for the unemployed person and inform the social insurance agency of the list of unemployed persons within fifteen days from the date of termination or dissolution of labor relations.
The unemployed person shall, with the certificate of termination or dissolution of labor relations issued by the employer, go to the designated public ****employment service agency to register as unemployed in a timely manner.
With the proof of unemployment registration and personal identification, the unemployed person shall go to the social insurance agency to go through the formalities for receiving unemployment insurance benefits. The period of receiving unemployment insurance benefits is calculated from the date of registering as unemployed.
