Factory paid social security resigned can refund money back

When a worker resigns, the employer has no right to refund the social security paid by the worker, but the worker's social security can be transferred. After leaving the job, the original organization makes a reduction from its company account, and then the worker can either continue to pay social insurance on his own as a freelancer, or transfer it to the account of the new company so that the new company can continue to pay social insurance.

"The Chinese People's **** and the State Labor Contract Law" Article 38 of the employer has one of the following circumstances, the worker can terminate the labor contract: (a) not in accordance with the labor contract agreement to provide labor protection or labor conditions; (b) not timely and in full payment of labor remuneration; (c) not in accordance with the law for the workers to pay social insurance premiums; (d) Where the employer's rules and regulations violate the provisions of laws and regulations to the detriment of the rights and interests of the workers; (e) Where the labor contract is invalidated due to the circumstances stipulated in the first paragraph of Article 26 of this Law; and (f) In other cases in which the workers may terminate the labor contract as stipulated by laws and administrative regulations. If an employer forces a worker to work by violence, threat or unlawful restriction of personal freedom, or if the employer endangers the worker's personal safety by directing or ordering risky work in violation of regulations, the worker may terminate the employment contract immediately without prior notice to the employer.
