What is unemployment insurance?

Unemployment insurance is one of the five social security risks, and it is a system enforced by the state through legislation. Employers, employees' individual contributions and state financial subsidies raise funds to establish unemployment insurance funds, provide material help to workers whose livelihood has been temporarily suspended due to unemployment, and create conditions for their re-employment through vocational training and employment introduction. Unemployment insurance is an important part of social security system and one of the main items of social insurance.

Unemployment insurance is universal, mutually beneficial and compulsory. People who participate in unemployment insurance can receive unemployment benefits if they meet the requirements. According to the Social Insurance Law, employees should participate in unemployment insurance, and employers and employees should pay unemployment insurance premiums in accordance with state regulations.

Unemployment insurance is compulsory;

First, the state collects social insurance premiums from employers and individuals within the prescribed scope in the form prescribed by law.

Second, the payer must fulfill the payment obligation, otherwise it will constitute an illegal act and bear the corresponding legal responsibility.

Generally speaking, which units and personnel should pay fees and how to pay them are stipulated by the state, and units or individuals have no freedom to choose. Therefore, if employers do not pay unemployment insurance, unless they cannot provide it, workers can complain to labor inspectors, who will order them to make corrections and collect late fees. If the employer fails to pay unemployment insurance, thus affecting the workers' inability to enjoy unemployment insurance benefits, it may apply for labor dispute arbitration for compensation.

Legal basis:

Article 45 of People's Republic of China (PRC) Social Insurance Law

Unemployed persons who meet the following conditions shall receive unemployment insurance money from the unemployment insurance fund:

(a) before unemployment, the employer and I have paid unemployment insurance premiums for one year;

(two) the employment is not interrupted because of my will;

(three) registered unemployed and have job requirements.

The unemployment insurance regulations stipulate that

The unemployment insurance fund consists of the following items:

(1) Unemployment insurance premiums paid by urban enterprises and institutions and their employees;

(2) Interest of the unemployment insurance fund;

(3) financial subsidies;

(four) other funds incorporated into the unemployment insurance fund according to law.
