When did social security begin to be paid?

The official payment of social security is about 1992, and the latest region is not later than 1996, so the social security payment was officially implemented during the four years from 1992 to 1996.

Social security is the "Provisional Regulations on the Collection and Payment of Social Insurance Fees" issued from 1999, but the payment time of different provinces, cities and industries is inconsistent. As early as 1992, state-owned enterprises basically started paying salaries from 1994. The monthly payment standard of social insurance for the insured is divided into four grades: the lowest grade (40%), the first grade (60%), the second grade (80%) and the third grade (100%).

At present, China has established social insurance systems such as basic old-age insurance, basic medical insurance and industrial injury insurance.

Employers and workers must participate in social insurance and pay social insurance premiums according to law.

Article 38 (3) If the employer fails to pay the social insurance premium for the employee according to law, the employee may terminate the labor contract. Article 46 (1) If the employee terminates the labor contract in accordance with the provisions of Article 38 of this Law, the employer shall pay the employee economic compensation.

Article 47 stipulates that the economic compensation shall be paid according to the number of years the laborer has worked in the unit and the standard of paying one month's salary for each full year. For more than six months but less than one year, it shall be counted as one year; If it is less than six months, economic compensation of half a month's salary shall be paid to the workers. If the monthly salary of workers is three times higher than the average monthly salary of local workers announced by the people's government of the municipality directly under the central government or the city with districts where the employer is located, the standard for paying economic compensation to workers is three times the average monthly salary of workers, and the longest period for paying economic compensation to workers shall not exceed 12 years. The monthly salary mentioned in this article refers to the average salary of workers in the twelve months before the dissolution or termination of the labor contract.

Article 2 of the Social Insurance Law

The state establishes social insurance systems such as basic old-age insurance, basic medical insurance, industrial injury insurance, unemployment insurance and maternity insurance, so as to guarantee citizens' right to receive material assistance from the state and society in accordance with the law when they are old, sick, injured, unemployed and have children.

Article 57 of the Social Insurance Law

The employing unit shall, within 30 days from the date of its establishment, apply to the local social insurance agency for social insurance registration with its business license, registration certificate or unit seal. The social insurance agency shall, within fifteen days from the date of receiving the application, examine and issue the social insurance registration certificate. Where the social insurance registration items of the employing unit are changed or the employing unit is terminated according to law, it shall, within 30 days from the date of change or termination, go to the social insurance agency to handle the change or cancellation of social insurance registration.

The market supervision and management department, the civil affairs department and the organization management organ shall promptly inform the social insurance agency of the establishment and termination of the employing unit, and the public security organ shall promptly inform the social insurance agency of the birth, death, household registration, migration and cancellation of the individual.
