Notice on the Transfer and Continuation of Basic Pension Insurance Relationships for Unemployed Military Spouses

The People's Government of the Provinces, autonomous regions and municipalities directly under the central government of human resources and social security, financial department (bureau), the political departments of all military regions, the Joint Department of the military, the political departments of all military services, the Department of Logistics, the Political Department of the General Staff, the Management and Security Department, the General Armaments Political Department and the Department of Logistics.

In order to do a good job of transferring the basic pension insurance relationship of unemployed military spouses, according to the "General Office of the State Council on the Transmission of the Interim Measures for the Transfer and Continuation of the Basic Pension Insurance Relationship of Urban Enterprise Employees of the Ministry of Human Resources and Social Security and the Ministry of Finance", the General Office of the State Council has issued the "Interim Measures for the Transfer and Continuation of the Basic Pension Insurance Relationship of Urban Enterprise Employees of the Ministry of Human Resources and Social Security and the Ministry of Finance", and the "Interim Measures for the Transfer and Continuation of the Basic Pension Insurance Relationship of Urban Enterprise Employees of the Ministry of Finance". The Notice on Interim Measures for the Transfer and Continuation of Pension Insurance Relationships of Urban Enterprise Employees (Guo Ban Fa [2009] No. 66) and the Notice issued by the General Office of the State Council and the General Office of the Central Military Commission on the issuance of

(Guo Ban Fa [2012] No. 102) and other relevant national policies, combined with the reality of the military, are now notified of the relevant issues are as follows:

I. During the period of the unemployed spouses of the soldiers with the military, the financial departments of the military logistic (coalition logistics) authorities will establish individual pension insurance for them in accordance with the provisions of the law. In accordance with the provisions of the establishment of individual accounts for their pension insurance, record their pension insurance contributions during the period in the army.

Second, the spouses who are not employed with the military have participated in the basic pension insurance for urban enterprise workers before the military, the basic pension insurance relationship and funds are not transferred to the military, the original social insurance agencies (hereinafter referred to as social security institutions) to keep all the records of their participation and contributions, the individual account savings continue to be accrued interest in accordance with the provisions of the law.

Third, the spouses of unemployed military to realize employment and participate in the basic pension insurance for urban enterprise workers, by the military logistics (coalition) organs of the financial department of the pension insurance relationship and the corresponding funds, transferred to the new place of social security institutions. When transferring the pension insurance relationship, the unemployed military spouse is not subject to the condition that the male has reached the age of 50 and the female has reached the age of 40, and does not establish a temporary basic pension insurance contribution account. The place of their employment again across the provincial mobility, should be in accordance with the provisions of the State Council issued [2009] No. 66 document for processing.

Fourth, unemployed spouses with the military in the military retirement with the resettlement of the temporarily unemployed, by the military logistics (coalition) organs of the financial sector will be its pension insurance relations and the corresponding funds, transferred to the resettlement of the domicile of the local social security institutions. When transferring the pension insurance relationship, the unemployed military spouse is not subject to the condition that the male has reached the age of 50 and the female has reached the age of 40, and does not establish a temporary basic pension insurance contribution account. V. Unemployed spouses with the military to reach the state retirement age, by the military logistics (coalition) organs of the financial sector will be the pension insurance relationship and the corresponding funds, transferred to the domicile of the local social security institutions, in line with the conditions of basic pension insurance benefits for urban workers, in the domicile of the location of the retirement formalities and receive the basic pension insurance benefits for urban workers.

Eight, for the third, fourth, fifth provisions of this notice of the situation of the pension insurance relations and funds transfer, according to the following provisions:

(a) transfer of the handling procedures:

1. Army logistics (coalition) organs issued by the financial department "unemployed spouses of the military pension insurance contribution vouchers" (see annex).

Written application for the transfer of pension insurance relations, issued by the spouses of unemployed with the military pension insurance contribution vouchers, fill in the "basic pension insurance relations transfer application form" (see Annex 2).

3. The social security organization of the new place of participation or domicile accepts the "Application Form for Transfer and Continuation of Basic Pension Insurance Relationships" and related information in accordance with the regulations, and examines them. Within 15 working days from the date of acceptance, to the military logistics (coalition) organs of the financial department issued a "basic pension insurance relationship transfer contact letter" (see Annex 3).

4. The financial department of the military logistics (joint logistics) organs, within 15 working days from the date of receipt of the "letter of contact for the transfer and continuation of the basic pension insurance relationship", fill out and transmit the "transfer and continuation of the pension insurance relationship of the spouses not employed with the military information form" (see Annex.). The corresponding transfer of funds, while terminating the pension insurance relationship during the period in the army.

5. The social security organization of the new enrollment place or the domicile place will complete the relevant procedures within 15 working days after receiving the "Information Sheet on the Transfer of Pension Insurance Relationship of Unemployed Spouses with the Military" and the transfer of funds.

IX. X. xiv. The Ministry of Human Resources and Social Security, together with the Ministry of General Logistics, shall be responsible for the interpretation of this Circular.

xv. This Notice shall come into force on the date of its promulgation.
