Notice on the implementation standard of pension benefits for survivors of deceased workers

The Social Insurance Law was implemented in July 1 1, 2065438. According to the provisions of the Social Insurance Law, if an individual who participates in the basic old-age insurance dies due to illness or non-work, his survivors can receive funeral subsidies and pensions, and the required funds will be paid from the basic old-age insurance fund. The country is still studying the survivors' pension policy. Through research, the relevant pension implementation standards for the insured who died due to illness but not work are hereby notified as follows:

Since July, 20 1 1/year, if the insured (including retirees) died of illness or non-work-related, their survivors will still be implemented in accordance with the provisions of the Notice on Adjusting the Pension Policy for Survivors of Employees Died of Illness and Non-work-related (No.1 93) issued by the former Provincial Department of Labor and Social Security and the Provincial Department of Finance.

After the country has a new policy, it will be implemented according to the national policy.

In order to ensure the basic livelihood of the immediate family members of the employees who died of illness and non-work-related deaths in enterprises, according to the relevant provisions of the state, the relevant issues concerning the adjustment of the pension policy for employees who died of illness and non-work-related deaths in enterprises (including retirees, the same below) are hereby notified as follows:

First, the scope of supporting immediate family members.

Workers die, their family members have no wages, pensions and other fixed income, have no ability to work, rely on the workers to provide the main source of livelihood, and meet one of the following conditions, can be listed as the object of support:

1. The spouse of the deceased employee has reached the age of 60, and the female has reached the age of 55, or has been completely incapacitated by the labor ability appraisal institution at or above the prefecture level (the same below).

2. Parents of deceased employees (including biological parents, adoptive parents and stepparents who have a dependency relationship), grandparents of deceased employees whose parents died and did not enjoy pension benefits, male over 60 years old, female over 55 years old or completely incapacitated.

If one of the grandparents, parents or spouse of the deceased employee has a fixed income such as salary and pension, those who have no income will not be included in the scope of support for the deceased employee.

3. The children of the deceased employee (including legitimate children, illegitimate children, adopted children with dependency, stepchildren, including legitimate children, illegitimate children including posthumous children) are under the age of 18 or completely incapacitated.

The grandchild of the deceased employee (whose parents have died and are not entitled to a pension) is under the age of 18 or completely incapacitated.

4. The parents of the deceased employee are both dead, and their brothers and sisters (including half-brothers or half-brothers, adopted brothers and sisters, and step-brothers and sisters with dependent relationship) are under the age of 18 or completely incapacitated.

Two. Items and standards of workers' death pension

1. Funeral allowance: 2,000 yuan will be paid to the dead employees, and no unauthorized burial will be given in areas where cremation should be carried out (except those permitted by ethnic minorities and the state).

2. One-time hardship allowance: eight months' salary is paid to the immediate family before the death of the on-the-job employee; Retirees who die are given basic pensions to their immediate family members for 8 months before their death; Before the founding of the People's Republic of China, retired people and retired old workers died, and their immediate family members received a one-time subsidy for difficulties with reference to the standards of similar personnel in party and government organs. Those who have no immediate family members are not paid.

3. Pension for supporting immediate family members: If the deceased employee has immediate family members, regardless of the place of residence, the pension will be paid according to the minimum living guarantee standard for urban residents where the deceased employee lives. Immediate family members 1-3 people (including 3 people) shall be paid at 300% of the minimum living standard for urban residents, but the total pension approved for the first time shall not exceed the monthly payment salary or monthly basic pension of the deceased. In the future, the minimum living standard for urban residents in the place where the unit is located will be adjusted simultaneously.

4. According to the above regulations, if the pension standard for supporting immediate family members is lower than the standard set by the provincial labor and social security department in 20041February 15, it can be implemented according to the standard set by the document 3 1 1.

5. After the death of retired employees of enterprises and retired employees who participated in revolutionary work before the founding of the People's Republic of China, parents and spouses who meet the conditions for supporting immediate family members' pensions shall be paid a monthly pension to each person in addition to the pension according to the prescribed standards. 1937 After the death of the person who participated in the revolutionary work before July 6, the pension was added to 50 yuan; War of Resistance against Japanese Aggression participated in revolutionary work and added 40 yuan; 25 yuan participated in revolutionary work during the War of Liberation. Those who do not rely on the widowed to support their immediate family members will receive 25 yuan in addition to providing pensions according to the prescribed standards.

Three. Payment of employee death pension

1. If the retirees of the insured enterprises die, they shall pay funeral subsidies, one-time subsidies for living difficulties and pensions for supporting immediate family members from the endowment insurance fund; For retirees who have not participated in the enterprise, the funeral subsidy, one-time subsidy for living difficulties and pension for supporting immediate family members after death shall be paid by the enterprise in accordance with the provisions of this notice.

2. Funeral subsidies, one-time subsidies for living difficulties and pensions for supporting immediate family members after the death of employees of various enterprises in cities and towns shall be paid by enterprises in accordance with the provisions of this notice.

3. The insured enterprise restructuring, reorganization, closure, bankruptcy, the reason for enterprise pension from the enterprise asset liquidation expenses according to the average remaining life or the number of years to support immediate family members calculated one-time into the financial accounts at the same level, the implementation of two lines of revenue and expenditure management. Pensions that should continue to be paid shall be paid by social security institutions.

4. Unemployed persons who die during the period of receiving unemployment benefits shall be paid subsidies and pensions in accordance with the provisions of Anhui Province on unemployment insurance.

Four. Management of Survivor Insurance Business

1. The administrative departments of labor and social security at all levels are responsible for the policy implementation and supervision of survivors' pensions for employees who died due to illness but not work-related, and the pension insurance agencies at all levels are responsible for the qualification examination, verification and daily management of survivors' pensions.

2. After enterprise employees and retirees die due to illness or non-work-related, funeral grants, one-time living difficulties grants and pensions for dependent immediate family members are paid by social insurance agencies, and the employment and labor security agencies of the unit or community where the deceased employees work issue relevant certification materials, and declare and receive funeral grants, one-time living difficulties grants and pensions to local pension insurance agencies in accordance with policies and regulations, and report them to the administrative department of labor security at the same level for approval and implementation after being audited by pension insurance agencies at all levels.

2. Pensioners shall cease to enjoy the pension during the period of being sentenced or reeducation through labor. After being released from prison or released from education, those who still meet the conditions for receiving pensions will be restored to enjoy pensions in accordance with the prescribed standards.

4. This circular shall be implemented as of September 6, 2004. In the past, if the pension policy for employees who died of non-work-related illness was inconsistent with the provisions of this notice, the provisions of this notice shall prevail. In the future, the state will introduce new policies and implement them according to state regulations.
