How to continue to pay social security after leaving the company?

Legal analysis: According to the relevant laws and regulations of our country, after the employee resigns and leaves the company, his original unit will go through the formalities of stopping paying social security, and after the employee finds a new work unit, he can continue to participate in social security and pay fees in the new unit. For the workers who can't find a new work unit after leaving the company or the new unit doesn't purchase social security, they need to consult with the personnel department of the original unit when going through the resignation formalities, so that the original unit can continue to purchase social security for themselves at its own expense. Workers without units can also pay social security by themselves to the relevant social insurance departments.

Legal basis: Article 50 of the Labor Contract Law of People's Republic of China (PRC) (revised 20 12).

The employing unit shall issue a certificate of dissolution or termination of the labor contract at the time of dissolution or termination, and go through the formalities for the transfer of files and social insurance relations for the workers within 15 days. Laborers shall handle the work handover according to the agreement of both parties. If the employing unit should pay economic compensation to the workers in accordance with the relevant provisions of this law, it should pay it when the work handover is completed. The employing unit shall keep the text of the dissolved or terminated labor contract for at least two years for future reference.

Article 4 of People's Republic of China (PRC) Social Insurance Law (revised 20 18)

Employers and individuals in People's Republic of China (PRC) pay social insurance premiums according to law, and have the right to inquire about payment records and personal rights records, and require social insurance agencies to provide social insurance consultation and other related services. Individuals enjoy social insurance benefits according to law and have the right to supervise the payment of their own units.

Article 60

The employing unit shall declare itself and pay social insurance premiums in full and on time, and shall not postpone or reduce the payment except for legal reasons such as force majeure. The social insurance premiums that employees should pay shall be withheld and remitted by the employer, and the employer shall inform me of the details of paying social insurance premiums on a monthly basis. Individual industrial and commercial households without employees, part-time employees who have not participated in social insurance in the employing units and other flexible employees can pay social insurance premiums directly to the social insurance premium collection agencies.
