Standard for receiving death pension

The standard of death pension is as follows:

4. Received by the immediate family members of the deceased. If there is no immediate family member, the person or organization that organized the burial shall collect it as appropriate and issue relevant certificates;

5. Funeral expenses are unified, which only changes with time and region, and is not affected by the age of the deceased or other factors.

Death and funeral expenses generally need to be applied to the social security agency of the insured place, as follows:

1. If it is a public institution, the state will issue a one-time pension and funeral expenses after death;

2. If you have not participated in social security and have funeral expenses according to local regulations, you can consult the civil affairs department to apply.

The collection process of death and funeral expenses is as follows:

1. After the death of the party concerned, the family members (heirs) shall submit the death certificate or cremation certificate of the party concerned, the application form for funeral expenses and other materials in time;

2. After the social security audit, the legal heir shall inherit the personal account balance of endowment insurance according to the regulations, and the social security agency shall calculate the specific pension and funeral expenses for those who meet the requirements according to local regulations;

3. After the social security agency has completed the examination and approval, it will transfer the relevant funds to the original unit of the party concerned, and the original unit will notify the heir to receive the social security fund.

The materials required to receive death and funeral expenses are as follows:

1. Original Death and Funeral Certificate (i.e. cremation certificate) issued by the funeral home or original invoice for funeral service fee;

2. Application form for funeral expenses (to be filled out by the social security bureau manager);

3. The original of the Certificate of Account Cancellation issued by the public security organ;

4. Original or photocopy of Medical Death Certificate issued by medical institution or health administrative department (stamped with red seal);

Article 17 of the Social Insurance Law of People's Republic of China (PRC)

If an individual who participates in the basic old-age insurance dies due to illness or non-work, his survivors can receive funeral grants and pensions; Persons who have completely lost their ability to work due to illness or non-work-related disability before reaching the statutory retirement age can receive disability allowance. The required funds are paid from the basic old-age insurance fund.

Article 39 of the Regulations on Industrial Injury Insurance

If an employee dies at work, his close relatives shall receive funeral subsidies, dependent relatives' pensions and one-time work-related death subsidies from the industrial injury insurance fund in accordance with the following provisions:

(a) the funeral subsidy is the average monthly salary of employees in the overall planning area for 6 months;

(2) The pension for supporting relatives shall be paid to the relatives who provided the main source of livelihood before the death of the employee and were unable to work because of work according to a certain proportion of the employee's salary. The standard is: spouse 40%, other relatives 30%, widowed elderly or orphans 10%. The total approved pension of dependent relatives should not be higher than the salary of employees who died at work. The specific scope of supporting relatives shall be stipulated by the administrative department of social insurance of the State Council;

(three) the standard of one-time work death allowance is 20 times of the per capita disposable income of urban residents in the previous year.

If a disabled employee dies at work during the period of paid suspension, his close relatives shall enjoy the treatment stipulated in the first paragraph of this article.

If a disabled worker of Grade 1 to Grade 4 dies after the expiration of his unpaid leave, his close relatives may enjoy the treatment specified in Items (1) and (2) of the first paragraph of this article.
