What legal penalties will self-employed people face if they don't buy social security for their employees?

Article 4 of China's Social Insurance Law stipulates that employers and individuals in People's Republic of China (PRC) pay social insurance premiums according to law, and have the right to inquire about payment records and personal rights and interests records, and require social insurance agencies to provide social insurance consultation and other related services. Therefore, individual industrial and commercial households do not pay social security for employees and need to bear two responsibilities:

First of all. Self-employed individuals need to pay social security for their employees according to law, and bear late fees and corresponding fines. According to the provisions of Article 86 of China's Social Insurance Law, if an employer fails to pay social insurance premiums in full and on time, the social insurance premium collection agency shall order it to pay within a time limit or make up for it, and from the date of default, an overdue fine of 5/10000 shall be charged daily; Failing to pay within the time limit, the relevant administrative departments shall impose a fine of more than one time and less than three times the amount owed.

Secondly, if employees have accidents such as work-related injuries, individual industrial and commercial operators need to bear the corresponding liability for compensation. The second paragraph of Article 62 of the Regulations on Work-related Injury Insurance stipulates that if an employee of an employer who should participate in work-related injury insurance according to the provisions of this Ordinance suffers from work-related injuries, the employer shall pay the expenses according to the treatment items and standards of work-related injury insurance stipulated in this Ordinance. It can be seen that the employer should take the place of the social security fund to bear the corresponding compensation liability if the employee suffers from work-related injuries without paying social security.

Finally, even if employees voluntarily give up paying social security, then the employer must bear the responsibility according to law and cannot be exempted.
