How to pay social security for overseas personnel

Legal analysis: you can continue to pay social security in your own name, or you can entrust a company to help you pay. If you don't want to continue to pay the fees, according to Article 5 of document No.38 [2009] of Shanghai People's Development Society, foreigners who have obtained permanent (long-term) residency abroad, and employees from Taiwan, Hong Kong and Macao in Shanghai who are insured later, are under the age of 60 for men and under the age of 55 for women, and who leave the country by dissolving or terminating their labor (employment) relationship with the employer in this municipality, they can apply to the social insurance agency for terminating the basic old-age insurance relationship.

Legal basis: Article 23 of the Social Insurance Law of People's Republic of China (PRC), employees shall participate in the basic medical insurance for employees, and the employer and employees shall jointly pay the basic medical insurance premium in accordance with state regulations.

Individual industrial and commercial households without employees, part-time employees who have not participated in the basic medical insurance for employees and other flexible employees can participate in the basic medical insurance for employees, and individuals pay the basic medical insurance premium in accordance with state regulations.
