Article 92 If the administrative department of social insurance and other relevant administrative departments, social insurance management organizations, social insurance premium collection agencies and their staff divulge the personal information of employers and individuals, the persons in charge and other persons directly responsible shall be given sanctions in accordance with the law; and if any loss is caused to the employer or individual, he or she shall be held liable to pay compensation.

Article 93: State officials who abuse their powers, neglect their duties, or engage in malpractice for personal gain in the administration and supervision of social insurance shall be punished in accordance with the law.
Article 94 If violation of the provisions of this Law constitutes a crime, criminal responsibility shall be investigated according to law.
Article 82 Any organization or individual has the right to report or complain about violations of social insurance laws and regulations.
Social insurance administrative departments, health administrative departments, social insurance agencies, social insurance premium collection agencies, and financial departments and audit authorities shall, in accordance with the law, deal with reports and complaints that fall within the scope of their own departments and agencies; if they do not fall within the scope of their own departments and agencies, they shall notify and transfer them in writing to the department or agency that has the authority to deal with them. Authorized departments and agencies should be dealt with in a timely manner, without prevarication.
Article 83 Where an employer or an individual considers that the behavior of a social insurance premium collection agency infringes upon his or her lawful rights and interests, he or she may apply for administrative reconsideration or bring an administrative lawsuit in accordance with the law.
An employing unit or an individual may, in accordance with law, apply for administrative reconsideration or bring an administrative lawsuit against a social insurance agency that fails to register for social insurance, approve social insurance premiums, pay social insurance entitlements, carry out procedures for the transfer and continuation of social insurance, or infringes upon any other rights and interests in social insurance.
If an individual has a social insurance dispute with his or her employer, he or she may apply for mediation or arbitration or file a lawsuit in accordance with the law. If the employer violates the social insurance rights and interests of an individual, the individual may also request the social insurance administrative department or social insurance premium collection agency to deal with the matter in accordance with the law.
