Legal basis: Article 12 of the Provisional Regulations on the Collection and Payment of Social Insurance Premiums Contributing units and individuals shall pay the full amount of social insurance premiums in monetary terms. The social insurance premiums payable by individual contributors shall be withheld and paid by their organizations from their own wages. Social insurance premiums may not be reduced or waived.

Article 13 of the Provisional Regulations on the Collection and Payment of Social Insurance Premiums: If a contributing unit fails to pay and withhold social insurance premiums in accordance with the regulations, it shall be ordered by the administrative department of labor security or by the tax authorities to pay them by a specified date; and if it fails to pay them after the expiration of the period of time, in addition to making up the amount of the unpaid premiums, it shall be charged with a late fine of two thousandths of one percent of the amount of the outstanding premiums on a daily basis, starting from the date of the payment. The late payment fee is incorporated into the social insurance fund.

Article 23 of the Provisional Regulations on the Collection and Payment of Social Insurance Premiums: If a contributing unit fails to register for social insurance, register for change or cancel registration in accordance with the regulations, or fails to declare the amount of social insurance premiums payable in accordance with the regulations, the administrative department of labor security shall order a period of time to rectify the situation; if the circumstances are serious, the directly responsible supervisor and other personnel directly responsible may be sentenced to a fine of not less than RMB 1000 and not more than RMB 5000. 5,000 yuan fine; the circumstances are particularly serious, the directly responsible supervisors and other personnel directly responsible for the fine of 5,000 yuan or more than 10,000 yuan.
