What if the company's social security is late?

Legal analysis: if the employer fails to pay social security, the employee has the right to complain and report to the labor inspection department.

Legal basis: Article 74 of the Labor Contract Law of People's Republic of China (PRC), the labor inspection department has the right to supervise and inspect the employer's payment of social security, and has the right to order the employer to correct the company's failure to pay social security.

Article 58 of the Social Insurance Law of People's Republic of China (PRC), the employing unit shall, within 30 days from the date of employment, apply to the social insurance agency for social insurance registration for employees. If the social insurance registration is not handled, the social insurance agency shall determine the social insurance premium to be paid.
