Companies are required to pay housing fund for their employees, not privately.

If a company does not open a provident fund account for its employees after establishing a labor relationship with them, it is in violation of the Housing Provident Fund Regulations.

Article 37

In violation of the provisions of these regulations, if a unit fails to register for the payment of housing provident fund or fails to go through the procedures of setting up a housing provident fund account for its own employees, the housing provident fund management center shall order that this be done by a certain period of time; and if it fails to do so, it shall be fined from 10,000 yuan to 50,000 yuan.

Article 38

If, in violation of the provisions of this Regulation, a unit fails to pay or underpays its housing provident fund after the expiration of a period of time, the Housing Provident Fund Management Center shall order it to do so within a certain period of time; and if it fails to do so after the expiration of the period of time, it may apply to the People's Court for compulsory execution.
